HomeMy WebLinkAboutBy-law 3421/90 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 34~l/90 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment respecting Plans M-1210 and 40M-1267, Pickering. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Town of Pickering and Heldor Development Corporation entered into an Agreement dated June 16, 1980, Notice of which was registered on July 10, 1981 as Instrument No. LT128954, respecting the subdivision and development of Plans M-1210 and 40M-1267, Picketing; WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated June 16, 1980, Notice of which was registered July 10, 1981 as Instrument No. LT128954 between Heldor Development Corporation and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan M-1210 and 40M-1267, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 5th day of March, 1990. RELEASE AND DISCHARGE WHEREAS the Agreement dated June 16, 1980, Notice of which was registered July 10, 1981 in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT128954, between, HELDOR DEVELOPMENT CORPORATION hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 36 inclusive, Blocks 37 to 46 inclusive, Bridle Path Circle, Linwood Street, Parkdale Street and Redwood Lane on Plan M-1210 and Lots i to 41, inclusive, Blocks 42 to 57 inclusive, Bridle Path Circle, Grovedale Court, Linwood Street and Parkdale Street on Plan 40M-1267, all in the Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 5th day of March, 1990.
