BY-LAW NO. 3400 /90
Being a by-law to authorize the execution of a
Transfer of Storm Sewer Easement from Securi-
ty-Benton Developments Inc. to The Corporation
of the Town of Picketing over those parts of Lots
11-14 and 20, Plan 40M-1609, designated as Parts
3-7, Plan 40R-12589.
WHEREAS, The Corporation of the Town of Pickering requires storm sewer easements
over those parts of Lots 11-14 and 20, Plan 40M-1609, designated as Parts 3-7, Plan
40R-12589 for the purpose of draining storm water through Plan 40M-1609, and pursu-
ant to the provisions of section 193 of the Municipal Act, R.S.O. 1980, chapter 302,
the Council of The Corporation of the Town of Picketing may pass by-laws for
acquiring interests in lands;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer of Storm
Sewer Easement, in the form attached hereto as Schedule A, from Securi-
ty-Benton Developments Inc. to The Corporation of the Town of Picketing over
those parts of Lots 11-14 and 20, Plan 40M-1609, designated as Parts 3-7, Plan
40R-12589.
BY-LAW read a first, second and third time and finally passed this 19th day of
February, 1990.

2. The Transferor oovenanto that it shall not erect any b~Idiag ~ st, ctur* nor
place or remove any fill on or ~om any part of the lends ~thout the express
w~tten consent of the Transferee.
3. The Transferor hereby rele~les the Transfer~ from any cl~ which may
out o~ the exercise by the Transferee of the ~Sht and easement granted
by, or which may arise out of th~ t~stence or oper~ti~ of the st~ d~na~e
works, provided the Tr~sferee fills ~ ~11 ~xcsvations and ~s f~ ~s is prac~-
c~ble restores th~ surfac~ to the condition e~stin~ p~or to ~y ent~ theban
to ~x~rcise the ~8ht hereby
4. Th~ Tr~nsfe~r coven~ts thst it shall execute such ~u~ther assurances o~ the
~ht and easement sranted hereby as may be required by the Transferee.
5. The burden of this Transfer and of ~ tbs covenants contained herein shall run
with the lands b~rotn described.
6. This Transfer shall be btndin~ upon and shall enure to the benefie of the
parties hereto and their respec~ve successors and assigns.
LAND ~ENEFIT~ (DOMINANT TENEMENT)
7. The benefit of this Transfer and aB of the covenants contained her~n shall run
with all other lands and interests in land owned, occupied or used by the
Transferee, its successors and assigns for the pu~ose of operating and main-
taints stem drainage w~rks.
