HomeMy WebLinkAboutBy-law 3348/89 THE CORPORATION OF TIlE TOWN OF PIGKERING BY-LAW NO.3348 /89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment respecting Plan M-iO07, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Township of Picketing and Bidwell ttomes Limited entered into an Agreement dated July 10, 1974, Notice of which was registered on July 19, 1974 as Instrument No. 46885, respecting the subdivision and development of Plan M-1007, Picketing; and WHEREAS The Corporation of the Town of Picketing is the successor to The Corpo- ration of the Township of Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing IIEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated July 10, 1974, Notice of which was registered July 19, 1974 as Instrument No. 46885, between Bidwell Homes Limited and The Corporation of the Township of Picketing, respecting the subdivision and development of Plan M-1007, Picker- lng. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 18th day of December, 1989. Wayne Ar~urs, Mayor Bruce Taylor, Clerk T'q3WN OF LEGAL DEF'Ff RELEASE AND DISCHARGE WHEREAS the Agreement dated July 10, 1974, Notice of which was registered July lq, 1974, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. 46885, between, BIDWELL IIOMES LIMITED hereinafter referred to as the "Company" - and - THE CORPORATION OF TIlE TOWNSItlP OF PICKERING of which The Corporation of the Town of Picketing is the successor hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. TilIS RELEASE AND DISCHARGE affects the lands described as: Block D, Plan M-1007, in the Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF thc Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 18th day of December, 1989. THIS RELEASE AND DISCHARGE affects the lands described as: Block D, Plan M-1007, in the Town of Picketing, Regional Municipality of Durham.
