BY-LAW NO.3293/89
Being a by-law to authorize the execution of a
Release and Discharge of the Subdivision Agree-
ments respecting Plan M-1135, Picketing.
WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces-
sor thereof, The Corporation of the Town of Picketing entered into Agreements with
Dungarvan Investments Limited, Gil]ingham Investments Limited and Highcroft Invest-
ments Limited and Dungarvan Investments Limited, Gillingham Investments Limited and
Highcroft Investments Limited carrying on business as Lookout Point Developments
respecting the subdivision and development of Plan M-1135, Pickering; and
WHEREAS the terms and conditions of those Agreements have been complied with to
the satisfaction of the Town;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Release and Dis-
charge, in the form attached hereto as Schedule A, of the Agreement dated May
16, 1977, Notice of which was registered February 7, 1978 as Instrument No.
LTD61862, between Dungarvan Investments Limited, Gillingham Investments
Limited and Highcroft Investments Limited and The Corporation of the Town of
Picketing, respecting Lots 1-79 inclusive, Blocks A, B and C, Broadgreen
Street, Victor Court and Brian Court, Plan M-1135, Picketing;
2. The Mayor and Clerk are hereby authorized to execute a Release and Dis-
charge, in the form attached hereto as Schedule A, of the Agreement dated
August 2, 1974, Notice of which was registered February 27, 1975 as Instru-
ment No. LTD1556, between Dungarvan Investments Limited, Gillingham Invest-
ments Limited and Highcroft Investments Limited, carrying on business as,
Lookout Point Developments and The Corporation of the Town of Picketing,
respecting Lots 1-4 inclusive, Lots 39-44 inclusive and Lots 78 and 79, Plan
M-1135, Town of Picketing, Regional Municipality of Durham;
3. Schedule A hereto forms part of this By-law.
BY-LAW read a first, second and third time and finally passed this 6th day of No-
vember, 1989.
RELEASE AND DISCHARGE
WHEREAS the Agreements dated May 16, 1977 and August 2, 1974, in the Land Regis-
try Office for the Land Titles Division of Durham (No. 40) as Instrument Nos.
LTD61862 and LTD1556, between,
DUNGARVAN INVESTMENTS LIMITED,
GILLINGHAM INVESTMENTS LIMITED
and
HIGHCROFT INVESTMENTS LIMITED
and
DUNGARVAN INVESTMENTS LIMITED,
GILLINGHAM INVESTMENTS LIMITED
and
HIGHCROFT INVESTMENTS LIMITED,
carrying on business as,
LOOKOUT POINT DEVELOPMENTS
hereinafter referred to as the "Company"
- and -
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter referred to as the "Town",
provided for the subdivision and development of lands affected hereby; and
WHEREAS the terms and conditions of those Agreements have been complied with to
the satisfaction of the Town with respect to the lands affected hereby;
THE TOWN HEREBY remises, releases and forever discharges the Company, its suc-
cessors and assigns, from any and all liabilities, actions, causes of action, debts,
claims or demands of any kind whatsoever which the Company may have been, is, or
may become subject to pursuant to the provisions of both Agreements.
THIS RELEASE AND DISCHAI(C,E affects the lands described as:
Lots 1 to 79 inclusive, Blocks A, B and C. Broadgreen Street, Victor Court and
Brian Court. Plan M-1135; and Lots 1-4 inclusive. Lots 39-44 inclusive and Lots 78
and 79, Plan M-1135, Town of Pickering, Regional Municipality of Durham.
IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to
by its properly authorized officers.

may become subject to pursuant to the provisions of both Agreements.
THIS RELEASE AND DISCHARGE affects the lands described as:
Lots 1 to 79 inclusive, Blocks A, B and C, Broadgreen Street, Victor Court and
Brian Court, Plan M-1135; and Lots 1-4 inclusive, Lots 39-44 inclusive and Lots 78
and 79, Plan M-11B5, Town of Picketing, Regional Municipality of Durham.
