BY-LAW NO.3268 /89
Being a by-law to authorize the execution of a
Release and Discharge of the Subdivision Agree-
ment respecting Plan 40M-1281, Pickering, and to
repeal By-law 3164/89.
WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces-
sor thereof, The Corporation of the Town of Pickering and Pinnacle Investments
Limited entered into an Agreement dated October 4, 1982, Notice of which was
registered on October 3, 1983 as Instrument No. LT186373, respecting the subdivision
and development of Plan 40M-1281, Pickering;
WHEREAS the terms and conditions of that Agreement have been complied with to the
satisfaction of the Town;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Release and Dis-
charge, in the form attached hereto as Schedule A, of the Agreement dated
October 4, 1982, Notice of which was registered October 3, 1983, as Instrument
No. LT186373, between The Pinnacle Investments Limited and The Corporation
of the Town of Pickering, respecting the subdivision and development of Plan
40M-1281, Pickering.
2. Schedule A hereto forms part of this By-law.
3. By-law 3164/89 is hereby repealed.
BY-LAW read a first, second and third time and finally passed this 2nd day of
October, 1989,

RELEASE AND DISCHARGE
WHEREAS the Agreement dated October 4, 1982, Notice of which was registered
October 3, 1983, in the Land Registry Office for the Land Titles Division of Durham
(No. 40) as Instrument No. LT186373, between,
PINNACLE INVESTMENTS LIMITED
hereinafter referred to as the "Company~
- and -
THE CORPORATION OF THE TOWN OF PICKERING
hereinafter referred to as the "Town",
provided for the subdivision and development of lands affected hereby; and
WHEREAS the terms and conditions of that Agreement have been complied with to the
satisfaction of the Town with respect to the lands affected hereby;
THE TOWN HEREBY remises, releases and forever discharges the Company, its suc-
cessors and assigns, from any and all liabilities, actions, causes of action, debts,
claims or demands of any kind whatsoever which the Company may have been, is, or
may become subject to pursuant to the provisions of the Agreement.
THIS RELEASE AND DISCHARGE affects the lands described as:
Blocks 1 to 26, inclusive, Tanzer Court, Albacore Manor and Wayfarer Lane, Plan
40M-1281, in the Town of Picketing, Regional Municipality of Durham.
IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to
by its properly authorized officers.
DATED at Pickering, Ontario this 2nd day of October, 1989.
