BY-LAW NO. 3243/89
Being a by-law to authorize the execution of a
Collective Agreement between The Corporation of
the Town of Pickering and the Picketing Profes-
sional Firefighters' Association (January 1, 1989 -
December 31, 1990)
WHEREAS pursuant to the provisions of sections 5(1) and 7(1) of the Fire Depart-
ments Act, R.S.O. 1980, chapter 164, the Council of The Corporation of the Town of
Picketing may enter into an agreement, in writing, with the Pickering Professional
Firefighters' Association for the purpose of defining, determining and providing for
remuneration, pensions or working conditions of full-time firefighters as defined in
that Act;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Collective Agreement,
in the form attached hereto as Schedule A, between The Corporation of the
Town of Picketing and the Picketing Professional Firefighters' Association for
the purpose of defining, determining and providing for remuneration, pensions
and working conditions of full-time firefighters, from January 1, 1989 to Decem-
ber 31, ]990, both inclusive.
BY-LAW read a first, second and third time and finally passed this f4'h day of Au-
gust, 1989.

WHEREAS tim Parties Imreto wish to establish and matntatn collective bargaining rel&ttons between
the Corporation, its Ftreftgrrters and Fire Dispatchers, and to provide mectflnery for the prompt
and equitable disposition of grievances, and to establish and maintain mutually satisfactory
working conditions, flours and wages for all Ftrefig~ters and Fire Dispetclmrs wflo are subject to
tflo provisions of tMs Agreement;
AIYFICLE 1 - ~:~I)E OF AEJIE~
1,01 In t~ls Agreement, the term,
(al "Dispatcher" means a full-time Fire DispatCher of the Town of Picketing Fire
Department;
(b) "Ftreftg~ter" means a full-time Ftreftghter of the Town of Picketing Fire Department,
and includes a Captain, Officer and Inspector, but does not include a Fire C)flef or
Deputy CMef~ and
(c} "Employeo" means a Dtspatcflor or a Ftreftghter.
1.02 The provisions of this Agreement shell apply to all Employees in the Deparl~ent.
JLRTICLE 2 - R[CGGIIITIOli
2.01 The Corporation retains the sole right to manage all services and direct the working
forces, including the right tO ~lre, premote, transfer, reprimand, penalize, suspend,
dtsc)~rge or demote its Employees for Just cause. A claim of dtsciminatory pro~otton~
demotion or transfer or a claim that any Employee has been discharged, penalized or
suspended wttflout Just cause shall be the subject of a grievance and dealt with as
provided in Articles 18 and
2,02 The Association and the Employees recognize the right of the Corporation to delegate its
authertty to a c~tttee of the appropriate officials, to negotiate a renewal Agreement
or to participate in the resolution of grievances with Employees subject to the final
approval of any Agreement by the Corporation.
2.03 The Corporation recognizes the Association as tflo exclusive bargaining agent for all
Employees, and this Agreement shell be regarded as being applicable to all such B~ployees.
2.04 All Employees wMle in uniform, whether on or off duty, shell be governed by the rules
and regulations of the Oeparl~ent as established and published by t~ Fire CMef from
time to time.
2.05 All Employees that are now members of the Association shell remain members thereof and
the new Employees of the Department shell become members of the Association wittffn the
first 30 days of their probationary period and will continue their members~p in good
standing in the Association as a condition of continued emplojament.

7.03 The To~n will establts~ a Sick Leave Bank for tm benefit of Association members,
7.04 Wrere an B~ployee is entitled, as of the end of December 31st in any year, to accmulated
sick leave in excess of two days, all but two days thereof will be carried forward to tm
next year for tret ~ployee's use.
7.05 Any mount of sick leave to wrflch an ~ployee is otherwise entitled but wldch will not be
carried forward to ire next year pursuant to Article 7.04 shell be accumulated tn trw Stck
Leave Bank.
7.06 Where an E~ployee res exreusted ~ls sick leave entitlement and is unable to work because
he is stck, he may apply to tm Corporation for a draw upon trw accumulated stck leave, tf
any, in the Sick Leave Bank.
7.07 Upon receipt of an application for a Sick Leave Bank draw, the Corporation srell notify
the Association of trw name of the mployee applytng and the mount of stck leave applied
for, if known.
7.08 The Corporation srell grant an application for a Sick Leave Bank draw only wrere,
(a) trw Stck Leave Bank res accanulated stck leave sufficient to cover the draw; and
(b) t~e Association consents in writing to t~e draw,

8.01 The Corporation sre11 pay 100% of trw premium cost of tM following:
ia) Ontario Health Insurance Plan;
(b) Life Insurance to two and a relf times the annual salary of the E~ployee to tie
nearest ~lO0.O0 including an accidental deat~ and dismemberment provision;
(c) Major Medical Plan including Prescription Drugs;
id) Long Term Disability Plan providing 75% of salary under Article lO subject to a
maxim.,~ of $3,000,00 per month; there srell be a 17-week waiting perio<t before
cmmencement of LTD benefits.
(e) Vision care plan to provide up to ~80 every two years for glasses and/or contact
1 enses.
if) Uental Plan equivalent to trw Blue Cross Plan Nmber g, utilizing t~e 1988 O.D.A.

8.02 Each employee, as a condition of employment, will participate in the Life Insurance Plan
referred to in Article 8.0lib), above.

14.01 (1) Tm Corporation sm11 continue its contribution and the contributions of its e~ployees
to the present 0.M.E R.S Pension Plan wtflch presently provides a pension equal to 2%
of the Employee's annual contributory earnings during t~e 60 consecutive mont~ of
highest contributory earnings.

17.04 Wren tho Fire Prevention Officer is not on duty in tho Oepart~ent, a Fire Inspector - Grade 1
- may be required by tho Fire Chief to perform tho duties of tho Fire Prevention Officer and,
if so required, shall be paid at tho Fire Prevention Officer's rate.

18.01 The procedure governing discharge cases shell be pursuant to section 4 of the Fire
Oeperbments Act.
18.0~ Cases involving alleged unjust discipline or suspension shell start at Stage 1 of the
Grievance Procedure.
18.03 A Flreftgl~ber or Otspatcher wm is exonerated under section 18.01 hereof, or 18.02 hereof,
shell be reinstated and paid his salery for the time lost.
ARTICLE 19 - 61~IE~AgCE PRQCEIIUI~
19.01 The Employee shell appoint a Grievance Committee rrm ~aong their ambers of tm'er persons,
and shall notify the Corporation of the personnel of such Cceaittee and any changes made
therein from time to time.
19.Og In the event of a complaint or grievance relating to the interpretation, application or
administration of this Agrement, including a~y allegation thee ems Agrement ms been
vtolate~ or any question as to whetter a matter is erbitrable, or as the result of any action
involving an Employee, he may then proceed as follows:
STAGE 1 The Employee may take up the matter in writing ,ith the Fire Chief or Oeputy
Chief not later than two days after the day of tqe incident complained of.
STAGE P - If the matter is not settled by the Ftre Chief or Deputy CMef witMn two days
of the day it was taken up with Ida at Stage 1, the Grievance Cceatttee,
accompanied by the Employee, may take the matter up with the Town Manager
within two days of the day it was first taken up with the Fire Crdef or Oeputy
Chief by the Employee.
STAGE 3 If the matter is not settled by the Town Manager within five days of tm day it
was taken up with him at Stage 2, it may be referred by the Grievance Camtttee
to the Executive Ccawntttee of Council, within seven days of the day it was
taken up with tre Town Manager.
STAGE 4 If the Ratter is not settled by the Executive C~lttee of Council, it may, by
notice in writing to the Town Manager, be referred to arbitration by tim
Grievance C~ittee under Article 20 of this Agr~ent within seven days of the
day it was first taken up with the Executive Caomtttee of Council.
Group Grievances
19.03 In case a group of Employees ~as a grievance, it sell be taken up by the Grievance Ca~mtttee
starting at Stage 2.
ae~erel Grievances
19.04 Any difference arising directly between the Association and the Te~m concerning the
interpretation or violation of tm terns or provisions of this Agrement may be Submitted to
either Party by the ot~er at Stage 2 within and not after ten days of the day of the incident
complained of.
1g.05 In detraining the time within which any step is to be taken under the foregoing provisions
of this Article, Saturdays, Sundays and statutory heltdays shell be excluded. Time limits
fixed by this Article may be extended by agreement in writing between the Parties.
19.0~ At any Stage of the Grievance Procedure, including arbitration, the conferring parties may
ave the assistance of the Employees concerned and any necessary witnesses, and all
reasonable arrangments sell be made to pratt the conferring parties to have access to the
Oeperbment, to view disputed operations and to confer with the necessary witnesses.
19.07 A decision at any Stage of the Grievance Procedure shall be in writing.
