HomeMy WebLinkAboutBy-law 3217/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3217/89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment respecting Plan 40M-1271, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Town of Picketing and Eaglebrook Corporation entered into an Agreement dated February 7, 1983, Notice of which was registered on June 30, 1983 as Instrument No. LT 177508, respecting the subdivision and development of Plan 40M-1271, Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated February 7, 1983, Notice of which was registered June 30, 1983 as Instrument No. LT 177508, between Eaglebrook Corporation and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan 40M-1271, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 26th day of June, 1989. RELEASE AND DISCHARGE WHEREAS the Agreement dated February 7, 1983, Notice of which was registered June 30, 1983, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT 177508, between, EAGLEBROOK CORPORATION hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 54 inclusive, Blocks 55-70 inclusive and Maple Ridge Drive, Cedarcroft Crescent and Windgrove Square on Plan 40M-1271, in the Town of Pickering in the Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Pickering, Ontario this 26th day of June, 1989.
