HomeMy WebLinkAboutBy-law 3203/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 320~/89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment, and amendments thereto respecting Plans M-1057, M-1058 and M-1059, Picketing and to repeal By-laws 3047/89, 3048/89 and 3049/89. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Township of Picketing and Bramalea Consolidated Developments Limited entered into an Agreement dated December 17, 1973, Notice of which was registered on March 5, 1976 as Instrument No. LTD16542, respecting the subdivision and development of Plans M-1057, M-1058 and M-1059, Picketing which Agreement was subsequently amended by Agreements dated November 15, 1976 and December ll, 1978, Notices of which were registered on March 17, 1977 and January 2, 1979 as Instrument Nos. LTD39669 and LT83421, respectively; and WHEREAS the terms and conditions of those Agreements have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering ttEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A of, (a) an Agreement dated December 17, 1973, Notice of which was registered March 5, 1976 as Instrument No. LTD16542, between Bramalea Consolidat- ed Developments Limited and The Corporation of the Township of Picker- ing; (b) an Amending Agreement dated November 15, 1976, Notice of which was registered March 17, 1977 as Instrument No. LTD39669; and (c) an Amending Agreement dated December ll, 1978, Notice of which was registered January 2, 1979 as Instrument No. LT83421; respecting the subdivision and development of Plan M-1057, M-1058 and M-1059, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 19th day of June, 1989. Wayne ~thur~ Mayor · -t TOWN OF , / APPROV£D / Bruce Tayl ,' C rk ,AS TO LEGAL RELEASE AND DISCHARGE WHEREAS the Agreement dated December 17, 1973, Notice of which was registered March 5, 1976, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LTD16542, between, BRAMALEA CONSOLIDATED DEVELOPMENTS LIMITED of which BRAMALEA LIMITED is the successor hereinafter referred to as the "Company" THE CORPORATION OF THE TOWNSHIP OF PICKERING of which The Corporation of the Town of Pickerin~ is the successor hereinafter referred to as the "Town", as amended by Agreements dated November 15, 1976 and December ll, 1978, Notices of which were registered on March 17, 1977 and January 2, 1979 in that Office as Instrument Nos. LTD39669 and LT83421, provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of those Agreements, as amended, have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company~ its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of all three Agreements. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 6-8 inclusive, 31, 39, 40, 42-44 inclusive, 47-52 inclusive, 79, 90, 91, 105, 145, 148-161 inclusive, 163-166 inclusive, 178, 179, 181, 183, 184, 188-196 inclusive, 198, 199, 203-232 inclusive, Blocks B, C and N and Shadybrook Drive, Briar Wood Gate, Eastbank Road, Meadowview Avenue, Edgewood Road, Cobbler's Court and Kate's Lane on Plan M-1057; Lot 244, 255-262 inclusive, 265, 270-280 inclusive, 282, 287, 290-293 inclusive, 295-298 inclusive 309, 32?-33? inclusive, 350, 351 and Blocks V-1 and W and Millbank Road, Parkside Drive, New Street, Una Road, Cricket Lane, Strouds Lane, Shadybrook Drive and Hedgerow Place on Plan M-1058; Lots 353-403 inclusive, Lots 406-446 inclusive and Blocks K-1 and N-1 and Parkside Drive, Aspen Road and Pebble Court on Plan M-1059; Lots 1-23 inclusive, Block A and Minstrel Manor on Plan M-1165; Lots 1-19 inclusive, Blocks 20-26 inclusive, Blocks 27-33 inclusive, Aspen Road and Stonepath Circle on Plan M-1219; and Blocks 1-8 inclusive and Belinda Court and Orion Court on Plan M-1227, ali in the Town of Picketing, Regional Municipality of Durham.
