HomeMy WebLinkAboutBy-law 3192/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 319~89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment and amendments thereto respecting Plan M-1222, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Town of Picketing and Maple Ridge Homes Ltd. entered into an Agreement dated March 2, 1981, Notice of which was registered on August 13, 1981 as Instrument No. LT131597, respecting the subdivision and development of Plan M-1222, Picketing, which Agreement was subsequently amended by Agreements dated May 4, 1981 and February 23, 1983, Notices of which were registered on August 13, 1981 and March 15, 1983 as Instrument Nos. LT131598 and LT167118, respectively; and ~ WHEREAS the terms and conditions of those Agreements as amended have been com- plied with to the satisfaction of the Town; NOW THEPoEFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated March 2, 1981, Notice of which was registered August 13, 1981 as Instrument No. LT131597, between Maple Ridge Homes Ltd. and The Corporation of the Town of Pickering, respecting the subdivision and development of Plan M-1222, Pickering. 2. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated May 4, 1981, Notice of which was registered August 13, 1981 as Instrument No. LT131598, between Maple Ridge Homes Ltd. and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan M-1222, Picketing. 3. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated February 21, 1983, Notice of which was registered March 15, 1983 as Instrument No. LT167118, between Maple Ridge Homes Ltd. and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan M-1222, Pickerlng. 4. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 19th day of June, 1989. RELEASE AND DISCHARGE WHEREAS the Agreement dated March Z, 1981, Notice of which was registered August 13, 1981 in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT131597, between, MAPLE RIDGE HOMES LTD. hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", as amended by the Agreements dated May 4, 1981 and February 21, 1983, Notices of which were registered on August 13, 1981 and March 15, 1983, in that Office as Instrument Nos. LT131598 and LT167118, provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of those Agreements as amended have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of all three Agreements. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 130 inclusive and Blocks 131 to 139 inclusive, Maple Gate Road, Meadowlane Crescent, Wildrose Crescent, Trailwood Court, Timber Court and Cedarwood Court in Plan M-1222 in the Town of Picketing in the Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 19th day of June, 1989.
