BY-LAW NO. 3167 /89
Being a by-law to authorize the execution of a
Release and Discharge of the Primary Development
Agreement respecting those parts of Lot 21,
Concession 1, Pickering, designated as Parts 20,
21 and 22, Plan 40R-10070 (Discovery Place,
Building 'A')
WHEREAS, pursuant to the Planning Act, R.S.O. 1970, chapter 349, J.D.S. Invest-
ments Limited, The Corporation of the Town of Pickering, and others, entered into an
Agreement dated January 17, 1977, a copy o£ which was registered December 5, 1977
as Instrument No. D60560, respecting, in part, the development of that part of Lot
21, Concession 1, Picketing, being Parts 20, 21 and 22, Plan 40R-10070; and
WHEREAS the terms and conditions of that Agreement have been complied with to
date, to the satisfaction of the Town;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Release and
Discharge in the form attached hereto as Schedule A, of the Agreement
dated January 17, 1977, a copy of which was registered December 5,
1977, as Instrument No. D60560 between J.D.S. Investments Limited and
The Corporation of the Town of Pickering and others, insofar as that
Agreement affects the development of Part Lot 21, Concession 1, Picker-
ing, being Parts 20, 21 and 22, Plan 40R-10070.
2. Schedule A hereto forms part of this By-law.

1989.

WHEREAS, the Agreement dated January 17, ]9??, a copy of which was registered
December 5, 1977, in the Land Registry Office for the Land Registry Division of
Durham (No. 40) as Instrument No. D60560, between,
J.D.S. INVESTMENTS LIMITED
herein called the "Owner"
- and -
THE CORPORATION OF THE TOWN OF PICKERING
herein called the "Town"
- and -
BENJAMIN PAPE ASSOCIATES LIMITED;
LLOYD LAVINE AND HAROLD STROM;
F.T. DEVELOPMENTS LIMITED;
LEXTON DEVELOPMENTS LIMITED;
VERMONT DEVELOPMENT COMPANY LIMITED;
ROBERT W. BYRON
herein collectively called the "Mortgagees and Encumbrancers"
provided for the development of lands affected hereby amongst others; and
WHEREAS the terms and conditions of that Agreement have been complied with to date
to the satisfaction of the Town with respect to the lands affected hereby;
THE TOWN HEREBY remises, releases and forever discharges the Owner, the
Mortgagees and Encumbrancers, and their respective heirs, executors, administrators,
successors and assigns, from any and all liabilities, actions, causes of action, debts,
claims or demands of any kind whatsoever which the they or any of them, may have
been, are, or may become subject to pursuant to the provisions of the Agreement.
THIS RELEASE AND DISCHARGE affects the lands described as:
Those parts of Lot 21, Concession 1, designated as Parts 20, 21 and 22, Plan
40R-10070, in the Town of Pickering in the Regional Municipality of Durham.
IN WITNESS WHEREOF the Town has hereunto affixed its corporate sea] attested by
its properly authorized officers.
