HomeMy WebLinkAboutBy-law 3159/89 THE CORPORATI,O~N OF THE TOWN OF PICKERING BY-LAW NO. 3159/89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment respecting Plan M-1189, Pickering, and to repeal By-law 2992/89. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Town of Picketing and Bramalea Limited entered into an Agreement dated July 30, 1979, Notice of which was registered on March 1980 as Instrument No. LT105597, respecting the subdivision and development of Plan M-1189, Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated July 30, 1979, Notice of which was registered March 12, 1980 as Instrument No. LT105197, between Bramalea Limited and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan M-i189, Picketing. 2. Schedule A hereto forms part of this By-law. 3. By-law 2992/89 is hereby repealed. BY-LAW read a first, second and third time and finally passed this 5th day of June, 1989. Btu e~~T~ fe~/r~Wayne Ar~urs, May~~ I TOWN OF PICKERING APPROVED LEGAL D~ RELEASE AND DISCHARGE WHEREAS the Agreement dated July 30, 1979, Notice of which was registered March 12, 1980, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT105197, between, BRAMALEA LIMITED hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessor and assigns, from any and ali liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 109, inclusive, Blocks 110 to 116, inclusive, Anthony Court, Houston Court, Cowan Circle, Foster Court, Moorelands Crescent and Toynevale Road all on Plan M-1189, in the Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Plckering, Ontario this 5th day of June, 1989.
