HomeMy WebLinkAboutBy-law 3141/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3141/89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment respecting Plan M-1219, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Town of Pickering and Bramalea Limited entered into an Agreement dated March 2, 1981, Notice of which was registered on July 13, 1981, as Instrument No. LT129144 respecting the subdivision and development of Plan M-1219, Picketing; WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated March 2, 1981, Notice of which was registered July 13, 1981 as Instrument No. LT129144 between Bramalea Limited and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan M-1219, Pickering. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 56~ day of June, 1989. fBrU%e Taylor, C'lerJ~' TOWN OF PICK F.'RING APPROVED AS TO FORM RELEASE AND DISCHARGE WHEREAS the Agreement dated March 2, 1981, Notice of which was registered July 13, 1981, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT129144 between, BRAMALEA LIMITED hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1 to 19, inclusive, Blocks 20 to 26, inclusive, Aspen Road and Stonepath Circle on Plan M-1219 in the Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 5th day of June, 1989.
