BY-LAW NO. 3107/89
Being a by-law to authorize the execution of a
Transfer of storm sewer easement from Bramalea
Limited to The Corporation of the Town of
Picketing over those parts of Lots 50, 51, 85, 86
and 87, Plan 40M-1571, Pickering, designated as
Parts 1-5, Plan 40R-11878.
WHEREAS, The Corporation of the Town of Pickering requires storm sewer easements
over parts of Lots 50, 51, 85, 86 and 87, Plan 40M-1571, Picketing, for the purpose
of draining storm water through Plan 40M-1571, and pursuant to the provisions of
section 193 of the Municipal Act, R.S.O. 1980, chapter 302, the Council of The
Corporation of the Town of Pickering may pass by-laws for acquiring interests in
lands;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer of storm
sewer easement, in the form attached hereto as Schedule A, from Bramalea
Limited to The Corporation of the Town of Pickering over those parts of Lots
50, 51, 85, 86 and 87, Plan 40M-1571, Pickering designated as Parts 1-$, Plan
40R-11878.
BY-LAW read a first, second and third time and finally passed this 17th day of April,
1989.

The free uninterrupted and unobstructed right and ealement in
perpetuity to construct, operate and maintain ItOrmwatlr run-off

with any and all appuz~canances thereto as may be required from time to
time in, under and scroll the lands described herein.

equipment, machinery and veh£cles to enter upon said lands at all times
and to pass and repass thereon for the purpose of constructing and
reconstructing, examining, repairing, renewing or replacing and maintainin<
the said storm water run off and catch baei~a or any part thereof whether
or not any part to be ao constructed, re~aired, renewed, replaced or
maintained is situate on the lanai described herein.

described herein unto the Transferee, its lucceliorl and assigns for its
and their sole and only use forever.
AND the Transferor covenantl that it will not erect any buildings or
structures, place or remove any fill on any part of the lands herein.
AND the Transferor.hereby relealel the Transferee from any and every
claim which may or might drill out of the exerclla by the Transferee of
any of the rights granted by this indenture or which may arise out of the
exiltenca or operation of the storm water run off end catch basins and
accep~ the consideration above-mentioned In full satisfaction of all such
claiml, provided ~he Transferee fills in all excavations and as far as is
practicable, restorel the surface to the condition exilting prior to any
entry thereon to exercise the ~ightl thereby granted.
