HomeMy WebLinkAboutBy-law 3101/89 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 3101/89 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agree- ment respecting Plan M-1165, Pickering. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predeces- sor thereof, The Corporation of the Town of Picketing and Bramalea Limited entered into an Agreement dated July 10, 1978, Notice of which was registered on January 2, 1¢79, as Instrument No. LT83422, respecting the subdivision and development of Plan M-1165, Pickering, WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickerir~ HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Dis- charge, in the form attached hereto as Schedule A, of the Agreement dated July 10, 1978, Notice of which was registered January 2, 1979, as Instrument No. LT83422 between Bramalea Limited and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan M-1165, Pickering. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 17th day of April, 1989. Wayne Ar tj~firs, RELEASE AND DISCHARGE WHEREAS the Agreement dated July 10, 1978, Notice of which was registered January 2, 1979, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT83422, between, BRAMALEA LIMITED hereinafter referred to as the "Company" - and - THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its suc- cessors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-23, inclusive, Block A and Minstrel Manor on Plan M-1165, in the Town of Picketing in the Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this l?th day of April, 1989. WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1.
