BY-LAW NUMBER 3092/89
Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement
the Official Plan of the Town of Pickering District Planning Area, Region of Durham in
Lot 62, Plan 1051~ in the Town of Picketing.

WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to
permit the establishment of two residential lots on the subject property~ each having a
minimum lot frontage of 15 metres;
AND WHEREAS an amendment to By-law 3036~ as amended, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING
HEREBY ENACTS AS FOLLOWS:
1. BY-LAW 3036
By-law 3036, passed by the Council of the Corporation of the Township (now Town) of
Picketing on the 3rd day of August 1965, and approved by the Ontario Municipal Board on
the 7th day of October 1966, and amended from time to time, is hereby further amended
only to the extent necessary to give effect to the provisions of Sections 2 and 3 hereof.
2. SCHEDULE "A" AMENDMENT
Schedule "A" to By-law 3036, as amended, is hereby further amended by changing from
"RY' (One-Family Detached Dwelling - Third Density Zone) to 'Rq" (One-Family Detached
Dwelling - Fourth Denisty Zone) and "OS-HL" (Open Space - Hazard Land Zone) the zone
designation of lands designated "R#" and 'OS-HL" on Schedule I attached hereto being Lot
62, Plan 1051 (Parts [~ 2~ 3, t~ 5 and 6~ t~0R-[ 176t4)~ Picketing.
3. TEXT AMENDMENT
Section 10 of By-law 3036, is hereby further amended by adding thereto the following
subsection:
10.3.5 Lot 62, Plan 1051
(l) Despite the front yard provision of Section 10.2.3 and the height
requirement provision of Section 5.9 of this By-law, Lot 62, Plan 1051 may
be used for residential one-family detached dwelling purposes, subject to
the following provisions:
(a) FRONT YARD DEPTH (minimum): 12.0 metres
(b) BUILDING HEIGHT (maximum): 9.0 metres
(2) (a) Uses Permitted ("OS-HL" zone)
No person shall within the land designated "OS-HL" on Schedule I
attached hereto, use any land for any purpose except the
preservation and conservation of the natural environment, soil and
wildlife.

(b) Zone Requirements ("OS-HL" Zone)
No buildings or structures shall be permitted to be erected, nor any
existing buildings or structures be modified or changed, nor shall the
placing or removal of fill be permitted, except where buildings or
structures are used only for purposes o£ flood and erosion control.
(3) Special Regulations
(a) Despite the side yard provision of Section 10.2.3, the minimum south
side yard width for a detached dwelling located on that part of Lot
62~ Plan 10-~1, designated Part 1, Plan ~0R-1176# shall be 2.33
metres.
(b) Paragraph (a), above, shall not apply where a detached dwelling or
any extension thereof is constructed after November 23rd,
EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board~ if required.
