BY-LAW NO. 3022/89
Being a by-law to authorize the execution of
Transfers of storm sewer easements in Plan
40M-1482, Picketing, to The Corporation of The
Town of Picketing over Part Lots 2 and 21, Plan
40M-1482 (Parts 1 and 2, Plan 40R-11785).
WHEREAS, The Corporation of the Town of Pickering requires storm sewer easements
over those parts of Lots 2 and 21, Plan 40M-1482, Picketing, designated as Parts 1
and Z, Plan 40R-11785 for the purpose of draining storm water through Plan
40M-1482, and pursuant to the provisions of section 193 of the Municipal Act, R.S.O.
1980, chapter 302, the Council of The Corporation of the Town of Pickering may pass
by-laws for acquiring interests in lands;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer of storm
sewer easement, in the form attached hereto as Schedule A, from Kurrie Storey
and Deborah Storey to The Corporation of the Town of Pickering over that part
of Lot 2, Plan 40M-1482, Picketing, designated as Part 1, Plan 40R-11785.
2. The Mayor and Clerk are hereby authorized to execute a Transfer of storm
sewer easement, in the form attached hereto as Schedule B, from Egon Viktor
Weldenborner and Anneliese Weidenborner to The Corporation of the Town of
Picketing over that part of Lot 21, Plan 40M-1482, Picketing, designated as
Part 2, Plan 40R-11785.
BY-LAW read a first, second and third time and finally passed this 6th day of
February, 1989.

Nature of Easement Transferred
The free, uninterrupted and unobstructed right and easement f r
the Transferee, its successors and assigns, and its and the,,'
agents, employees and contractors to use the lands describud in
Box 5 (the "Lands") for the purpose of constructing,
reconstructing, examining, repairing, renewing or replacing and
maintaining a storm sewer system or any part thereof whether or
not any part to be so constructed, repaired, renewed, replaced or
maintained is situate on the Lands, subject to the covenants set
out below.
Covenants Relatin~ to Easement Transferred
1. The Transferor and its successors and assigns shal! keep the
Lands free and clear of all buildings and structures, except
fences, and shal! not place or remove any fi1! on or from
the Lands, nor do or permit to be done any other thing which
may injure or damage any of the~Transferee's works thereon.
2. The Transferee shall as far as is practicable restore the
Lands to the condition existing prior to any entry thereon
to exercise the rights hereby granted.
3. The burden of this indenture and of all the covenants, terms
and conditions herein contained sha!l run with the Lands and
with ai1 other lands and interests in lands owned, occupied
or used by the Transferee, its successors and assigns, for
the purpose of operating and maintaining the storm sewer
system and this indenture shall be binding upon and enure to
the benefit of the par%ies hereto, their respective
successors and assigns.
