BY-LAW NO. 2996/89
Being a by-law to authorize the execution of a
Transfer of storm sewer easement to The
Corporation of the Town of Picketing over that
part of Lot 106, Plan 40M-1466, Pickering,
designated as Part 5, Plan 40R-10283.
WHEREAS, The Corporation of the Town of Picketing requires a storm sewer easement
over part of Lot 106, Plan 40M-1466, Pickerlng, for the purpose of draining storm
water through Plan 40M-1466, and pursuant to the provisions of section 193 of the
Municipal Act, R.S.O. 1980, chapter 302, the Council of The Corporation of the Town
of Picketing may pass by-laws for acquiring interests in lands;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer of storm
sewer easement, in the form attached hereto as Schedule A, from Lindell
Humphrey, Eulando Humphrey and Muriel Humphrey to The Corporation of the
Town of Picketing over Part Lot 106, Plan 40M-1466, Picketing, (Part 5, Plan
40R-10283).
BY-LAW read a first, second and third time and finally passed this 16th day of
January, 1989.

~ature of Easement Transfe~ed
The free, uninterrupted and unobstructed right and easement for the Transferee, its suc-
cessors and assigns, and its and their ~gents~ employees and contractors to use the lands
described in Box 5 (the ~Landsn) for the pu~ose of constructing, reconstructing, examin-
er, repairer, fencing or replacing and maintai~ng a storm sewer system or any part
thereof whether or not any part to be so constructed~ repaired~ renewed, replaced or
maintained is situate on the Lands, subject to the covenants set out below,
Covenants Relatin~ to Easement T~ansfer~ed
~. The Transferor and its successors ~d assigns shall keep the ~nds free and clear of
all buildings tnd struct~es, except fences, and shtll not pltce or remove thy flu on or
from the Lands, nor do or permit to be done any other thinS which may ~Jure or
damage any of the ~ransferee~s works thereon.
2. The Transferee shall as far as is practicable restore the Lands to the condition existing
prior to ~ny entry thereon to exercise the ~ghts hereby granted.
3, The burden of this indenture and of all the covenants, terms and conditions herein
contained shall run with the Lands and with all other ]ands and interests in lands
owned, occupied or used by the Transferee, its successors and assigns, for the pur-
pose of operating ~nd mainta~nin~ the storm sewer system ~nd this indenture shall be
binding upon and enure to the benefit of the parties hereto, the~ respective successors
and assigns,
