40M-1554).
' WHEREAS, The Corporation of the Town of Pickering requires a storm sewer easement
over that part of Lot 27, Concession 2, Pickering, designated as Part 1, Plan
40R-11472, for the purpose of draining storm water through Plan 40M-1554, and
pursuant to the provisions of section 193 oF the Municipal Act, R.S.O. 1980, chapter
302, the Council of The Corporation of the Town of Pickering may pass by-laws for
acquiring interests in lands;

NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer of storm
sewer easement in the form attached hereto as Schedule A, from Jameton Limited
to The Corporation of the Town of Pickering over that part of Lot 27,
Concession 2, Pickering, designated as Part 1, Plan 40R-11472 (Fairport
Developments Inc., Plan 40M-1554).
BY-LAW read a first, second and third time and finally passed this 17th day of
October, 1988.

1. The Tran�fssor hsreby tran�fert to the Transfsrae the free, uninterrupted and
unobstructed right and easement to construct, operate snd matntain such storm
drainage aorks, together with any appurtenancea thereto aa may be requfred
from time to time in, under and acrose the landa herein deacr(bed, together
wlth a right of the Tranaferee, ita succesaora and asalgne and ite and their
servanta, agenta and workmen, with all necessary equipment, machinery and
vehiclea to enter upon the landa at all timee and to pasa and repass thereon tor
replacing (including replacement with etorm drainage works of larger stze and
capacity) and maintafning the etorm drainage worka or any part thereof or
appurtenancee thereto to be conetructed. reconetructed, examined, repairad,
renewad, replacad or maintainad situate on the landa.

place or remove any fill on or from any part of the landa aithou! the express
wrltten conaent of the Tranaferee. '
3. The Transferor hereby releasee the Traneferee from any clalm which may arlae
out of the exerciee by the Traneferee of the right and 'easement granted here-
by, or which may azlae out of the exiatence or operatlon of the etorm dralnage
worka, providad the Traneferee fille in all excavations and ae far as ie practi-
cable reetorea the surface to the condition exiating prior to any entry thereon
to exerclse the rfgh! hereby granted. •

The Transferor covenants that it ehall execute such further assurancee of the
rlght and easeman! granted heraby as may be requfred by the Tranaferee.
The burden of this Transfsr and of all the covenanta contained herein shall run
with the lands herain described. ,

Being a by-law to authorize the execution of a
Transfer of storm sewer easement from Jameton
Limited to The Corporation of the Town of Picker-
ing over Part Lot 27, Concession 2(Part 1, Plan
40R-11472) (Fairport Developments Inc. , Plan
40M-1554).
WHEREAS, The Corporation of the Town of Pickering requires a storm sewer easement
over that part of Lot 27, Concession 2, Pickering, designated as Part 1, Plan
40R-11472, for the purpose of draining storm water through Plan 40h9-1554, and
pursuant to the provisions of section 193 of the Municipal Act, R.S.O. 1980, chapter
302, the Council of The Corporation of the Town of Pickering may pass by-laws for
acquiring interests in lands;
NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1, The Mayor and Clerk are hereby authorized to execute a Transfer of storm
sewer easement in the form attached hereto as Schedule A, from Jameton Limited
to The Corporation of the Town of Pickering over that part of Lot 27,
Concession 2, Pickering, designated as Part 1, Plan 40R-11472 (Fairport
Develop ments Inc., Plan 40M-1554).
BY-LAW read a first, second and third time and finally passed this 17th day of
October, 1985.
