THE CORPORATION OF THE TOWN OF PICKERING
BY-LAW N0�941 /88
Being a by-law to authorize the execution of a
Transfer of a storm sewer easement in Plan
40M-1466, to The Corporation of the Town of
Pickering over Part Lot 105, Plan 40M-1466, (Part
7, Plan 40R-10283).
WHEREAS, The Corporation of the Town of Pickering requires a storm sewer easement
over that part of Lot 105, Plan 40M-1466, Pickering, designated as Part 7, Plan
40R-1�283; for the purpose of draining storm water through Plan 40M-1383, and
pursuant to the provisions of section 193 of the Municipal Act, R.S.O. 1980, chapter
302, the Council of The Corporation of the Town of Pickering may pass by-laws for
acquiring interests in lands;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY
ENACTS AS FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Transfer of storm
sewer easement, in the form attached hereto as Schedule A, from William James
Burnett and Maureen Farmer to The Corporation of the Town of Pickering over
, that part of Lot 105, Plan 40M-1466, Pickering, designated as Part 7, Plan
40R-10283.

The free, uninterrupted and unobstructed right and easement for the Transferee, ita sue-
eesso:s and as�iQns, and its and their agent�, employees and eontraetors to use the lands
de�eribed in Box 5(the "Landi") for the purpo�e of eonstrueting, reeon�trueting, examin-
ing, repairinQ, reneaing or replacina and maintaining a storm seae: �ystem or any part
thereof �vhether or not any part to be �o eonstrueted, repaised, zenewed, replaced or
maintained is �ituste on the Lands, subject to the covenants �et out below.
Covenanta RelatinQ to Easement Transferred
The Transferor and its �uecessors and aisigns �hall keep the Lands free and elear of
all buildinas and struetures, except fences, and shal] not plaee or remove aay fill on or
from the Lands. nor do or permit to be done aay other thinQ �vhich may injure or
damage any of the Tranaferee's aorka thereon.
2. The Transferee shal] as far aa is practicable reetore the Lands to the condition existing
prior to any entry thereon to exercise the rights hereby granted.
The burden of thie indenture and of all the eovenants, terms and conditions herein
eontsined ahall run with the Lands and w3th all other lands and interests in lands
owned, oeeupied or used by the Transferee, its �uccessors and as�igna. for the pur-
pose of operating and maintaining the �torm sewer system and this indenture shall be
binding upon and enure to the benefit of the parties hereto, their respeetive successors
and assigna.
