SINGER Member THE BOARD ORDERS that this application be granted and that the applicant may proceed with the Community Improvement Project as described in Schedule "A" annexed hereto and may borrow money by way of temporary advances a sum not exceeding $1,260,000.00 and shall raise out of current revenue the sum of $590,000.00 with interest over each of the years 1988, 1989 and 1990 sufficient to repay such temporary advances, provided that the Council of the applicant corporation in exercising any power approved by this order shall comply and conform with all statutory and other legal requirements related thereto. SECRETARY THE CORPORATION OF THE TOWN OF PICKERING BY-LAW No. 2672/88 Being a By-law to adopt a Community Improvement Plan for the Bayview Street Rehabilitation Area of the Town Picketing WHEREAS the Council of the Corporation of the Town of Pickering has designated by by-law the Bayview Street Rehabilitation Area, being lands in Part of Lots 23 and 2t~, Range 3, Broken Front Concession, Picketing, as a Community Improvement Project Area pursuant to section 28(2) of the Planning Act, S.O. 1983; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. The Community Improvement Plan for the Bayview Street Rehabilitation Area of the Town of Picketing, attached hereto as Schedule A, is hereby adopted. 2. That the Town Clerk is hereby directed to submit, pursuant to subsections 28(4) and 17(6) of the Planning Act S.O. 1983, the Community Improvement Plan for the Bayview Street Rehabilitation Area to the Minister of Municipal Affairs for approval. Schedule A to By-law 2672/88 COMMUNITY IMPROVEMENT PLAN BAYVIEW STREET REHABILITATION AREA TOWN OF PICKERING Adopted by the Council of the Corporation of the Town of Pickering on Page 1 COMMUNITY IMPROVEMENT PLAN BAYVIEW STREET REHABILITATION AREA 1.0 Community Improvement Goal 1.1 To improve living conditions in the Bayview Street Rehabilitation Area of the Frenchman's Bay and Shoreline Community. 2.0 Community Improvement Objectives 2.1 To secure under public ownership all private roads in the Bayview Street Rehabilitation Area, and improve these and other roads in the Area to appropriate municipal standards. 2.2 To extend municipal water and sanitary sewer services to all roads in the Bayview Street Rehabilitation Area that lack such services, and to upgrade municipal water and sanitary sewer services on other roads in the Area where upgrading is warranted. 2.3 To provide municipal storm drainage services to all roads in the Bayview Street Rehabilitation Area that lack such services. 3.0 Description of the Project Area 3.1 The boundary of the Community Improvement Project Area is shown on Map i to this Plan. This Area lies within the Frenchman's Bay Community Improvement Area that is delineated on Schedule "C" to Part I of the Rickering District Plan. 3.2 The Community Improvement Project Area delineated in this Plan shall be referred to in this Plan as the "Bayview Street Rehabilitation Area", or as the "BSRA", or as the "Area". The BSRA comprises an area of approximately 3.6 hectares (8.9 acres). Within this Area, there are 41 residential dwellings and 11 vacant residential lots (as of December 31st, 1987). Approximately 130 people now live in the Area. Over 50 percent of the existing dwellings in the BSRA are in poor or fair condition. Appendix III to this Plan provides a summary of land uses in the Area. Page 2 3.4 The only roads in the BSRA that are under public ownership are Front Street, the easterly section of Browning Avenue and Maple Street (also known as Fairview Avenue). All other roads in the Area are under private ownership. The only roads, public or private, in the BSRA that have the standard municipal road allowance width of 20 metres (GG feet) are Front Street, the easterly section of Browning Avenue, and St. Martin's Drive South. All others have less than this standard road allowance, most having a width of approximately 7.5 metres (30 feet). Other than Front Street and the easterly section of Browning Avenue, all roads in the Area are generally in poor condition. 3.6 Front Street, the easterly section of Browning Avenue and Maple Street are the only roads in the BSRA served by municipal water and sanitary sewer facilities. The services on Maple Street are below existing Regional standards. All other roads in the Area are unserviced by municipal water and sanitary sewer facilities. 3.7 Municipal storm drainage facilities do not exist on any roads in the BSRA. 4.0 Rationale for Community Improvements 4.1 The Community Improvement Policies of Part I of the Pickering District Rlan identify the Frenchman's Bay and Shoreline Area as a high priority area for community improvement works. 4.2 A Community Improvement Background Study completed by Macaulay Shiomi Consultants Limited in Oanuary 1986 also recognizes a high priority need for community improvements in the Frenchman's Bay and Shoreline Area. In addition, that Study makes specific reference to the need for improvements in the BSRA. Page The Frenchman's Bay and Shoreline Area Community Plan designates lands in the BSRA that front St. Martin's Drive South as "Resident£al Policy Area 5". The remainder of the Area is designated "Residential Policy Area 6". Policies for both residential areas permit the rehabilitation of existing residences as well as the construction of new residences. Before any significant rehabilitation or construction can occur~ however, municipal services must be extended to the Area, and roads must become municipally owned. 4.4 The BSRA has the most serious municipal servicing deficiencies of any lands in the South Rickering Major Urban Area. The road, water service, sanitary sewer and storm drainage deficiencies described in sections 3.4, 3.5 and 3.6 of this Plan pose significant risks to the health and safety of residents in the Area. 4.5 Two objectives of The Town's Community Improvement Policy of the Pickering District Plan are: to support private efforts to maintain and rehabilitate existing buildings and structures~ and, to upgrade or improve the existing level of physical services and facilities such as roads, street lights and sidewalks. The improvement of the substandard, unserviced private and public roads in the BSRA is directly within the intent of both of these objectives. 4.6 Once the required municipal improvements are undertaken in the BSRA, zoning by-law amendments may be enacted by Town Council. The purpose of these amendments will be to establish appropriate building and lot provisions for the BSRA that will enable the private rehabilitation and redevelopment of existing residences, and the construction of new residences on vacant lots in the Area. Specific Municipal Community Improvements The municipal community improvements to be implemented in the BSRA, their estimated gross costs, and potential sources of funding for them are described in this section. The location of specific projects and components is shown on Map 1 of this Plan. Page 4 5.2 Roads intended to become public roads under the Town's jurisdiction are Waterpoint Street, Bayview Street, Simpson Avenue, the westerly portion of Browning Street and St. Martin's Drive South. 5.3 Water service, sanitary sewer and storm drainage facilities will only be installed in the BSRA on public roads, or on roads to become public roads. 5.4 Water services and sanitary sewers are intended to be installed on all roads listed in section 5.2 of this Plan if such roads become public roads. Depending on the condition of the existing substandard services on Maple Street, new water services and sanitary sewers may also be installed on that road. 5.5 Storm drainage facilities are intended to be installed on all roads where water services and sanitary sewers become established, but only if feasible, taking into account both engineering and financial considerations. 5.6 Road improvements (including paving, street lighting and boulevard treatment) are intended to be undertaken for all roads where water services, sanitary sewers and, if feasible, storm drainage facilities become established. 5.7 The approximate estimated gross cost of all community improvements described in this Rlan is $1,200,000. An additional administration cost of up to approximately $60,000 may also be attributed to these improvements. 5.8 Sources of funding for the municipal community improvements described in this Plan, and for administration, may include regional revenues, local revenues, senior government assistance programs and local improvement levies such as frontage and connection charges. 6.0 Relationship Between The Specific Improvements And The Rationale For Community Improvements 6.1 The municipal community improvements described in section 5.0 of this Rlan provide direct solutions to the serious road, water service, sanitary sewer and storm drainage deficiencies found in the BSRA. By correcting these deficiencies, the Town's long-term urban servicing objectives will be more fully realized. Potential health and safety problems for residents in the Area will also be alleviated. Page 5 6.2 Public investment in municipal servicing of the BSRA, accompanied by appropriate zoning by-law amendments, will encourage private investment in both upgrading and rehabilitating residences in the Area. 7.0 Implementation and Interpretation 7.1 Minor changes to this Plan may be made without amendment to this Rlan. 7.2 Major changes to this Plan may only be made by amendment to this Rlan. 7.3 This Plan, and all amendments to it, shall not be implemented until approved by Town Council, Regional Council if necessary, and the Ministry of Municipal Affairs, unless otherwise specified by that Ministry. 8.0 Map and Appendices 8.1 Map 1 is attached to this Plan and forms part of this Plan. 8.2 Appendices I through 1V, inclusive, are attached to this Rlan only for informational purposes. They do not constitute part of this Plan and therefore may be amended, replaced, added to, or deleted without amendment to this Plan.
