BY-LAW NUMBER 2642/88
Being a By-law to amend Restricted Area (Zoning) By-law 2311, as amended by
By-law 9#1/79, to implement the Official Plan of the Town of Pickering District
Planning Area, Region of Durham, in Part of Lot 18, Range 3, B.F.C. (Parts I to 17,
Plan t~0R-799tt) in the Town o£ Picketing. (A 62/87)
WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 9#1/79
amending By-law 2511~ to permit the establishment of industrial and certain commercial
uses on the subject lands, being Part of Lot lg, Range 3, B.F.C. (Parts I to 17, Plan
t40R-7990) in the Town of Pickering;
AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it
desirable to amend Restricted Area (Zoning) By-law 2511, as amended by By-law 9t41/79, to
permit a commercial-recreational establishment, vehicle repair shop, and vehicle sales
shop as permitted uses and to prohibit outdoor display on the subject property;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. SCHEDULE AMENDMENT
(1) Schedule I of By-law 9t~1/79 is hereby revoked and Schedule 1 attached hereto
substituted therefor.
2. TEXT AMENDMENT
(1) Section 16.3.6.A(b) of By-law 2311 is hereby renumbered to 16.3.6.A(b)(i) and the
following subclause added thereto:
(ii) "Commercial-Recreational Establishment" shall mean a commercial
establishment in which indoor recreational facilities such as bowling alleys~
miniature golf courses, roller skating rinks, squash courts, swimming pools
and other similar indoor recreational facilities are provided and operated
for gain or profit, and which may include an arena or a stadium but shall
not include a place of amusement or entertainment as defined herein.
(2) Section 16.3.6.A(k) of By-law 2311 is hereby renumbered to 16.3.6.A(k)(i) and the
following subclause added thereto:
(ii) "Place of Amusement or Entertainment" shall mean a building or part of a
building in which facilities are provided for amusement or entertainment
purposes, and which may include a billiard or pool room, a dance hall, a
music hall, or a theatre, but shall not include a games arcade.
(3) Section 16.3.6.A(p) of By-law 2311 is hereby renumbered to 16.3.6.A(p)(i) and the
following subclause added thereto:
(ii) "Vehicle Repair Shop" shall mean an establishment containing facilities for
the repair and maintenance of vehicles on the premises~ in which vehicle
accessories are sold and vehicle maintenance and repair operations are
performed in return for remuneration, but shall not include a body shop or
any establishment engaged in the retail sale of vehicle fuels.
(iii) "Vehicle Sales Shop" shall mean an establishment in which vehicles are
displayed for sale, sold or both.

(4) Section 16.3.6.B.(ii) of By-law 2311 is hereby amended by adding thereto the
following permitted uses:
(m) commercial-recreational establishments, vehicle repair shops, and vehicle
sales shops subject to the provisions of Section 16.3.6.C(j)(v) of this By-law.
(3) Section 16.3.6.C(h) of By-law 2311 is hereby revoked and the following
substituted therefor:
(h) OPEN STORAGE:
All uses, ether than parking, shall take place entirely within enclosed
buildings or structures with no outside storage or display permitted.
(6) Section 16.3.6.C(j) of By-law 2311 is hereby amended by adding thereto the
following subclause:
(v) Notwithstanding any other provisions of this By-law, commercial-
recreational establishments, vehicle repair shops and vehicle sales shops
shall only be permitted on those lands cross-hatched on Schedule I attached
hereto.
3. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval
of the Ontario Municipal Board, if required.
