BY-LAW NO. 5746/00
Being a By-law to amend By-law 1612/83, as amended, which amends
Restricted Area (Zoning) By-law 3036, as amended, to implement the
Official Plan of the City of Piekering District Planning Area, Region of
Durham in Block A, Part Block B, Plan M-998, and Part of Lot 22,
Concession 1 in the City of Picketing.

WHEREAS the Council of the Corporation of the City of Pickerifig deems it desirable to amend
certain provisions on the lands zoned "C9" on Schedule II to By-law 1612/83;
AND WHEREAS an amendment to By-law 1612/83, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. SCHEDULE
Schedule II to By-law 1612/83 is hereby repealed and replaced with Schedule II attached
hereto.

Clause 5 (2)(d) of By-law 1612/83 is hereby replaced by the following provision:
"5 (2)(d) Outdoor Storage and Display:
No outdoor storage and display is permitted within the
lands designated "C9" on Schedule 'T' attached hereto."
Clause 5 (2)(e)(1) of By-law 1612/83 is hereby replaced by the following provision:
"5 (2)(e)(1)
For the purpose of this clause, "parking space" shall mean a
usable and accessible area, having a minimum width of 2.6
metres and a minimum length of 5.3 metres excluding aisle
space and driveways to the parking lot, for the temporary
parking of a vehicle.
Clause 5 (2)(e)(2) of By-law 1612/83 is hereby replaced by the following provision:
"5 (2)(e)(2)
There shall be provided and maintained a minimum of five
(5) parking spaces for each 100 square metres or part
thereof of gross leasable floor area."
Clause 5 (2)(f)(iii) is hereby replaced by the following provision:
"5 (2)(f)(iii)
the gross leasable floor area of all Retail Stores on the lands
designated "C9" on Schedule "II" shall not exceed 7200
square metres;"
Clause 5 (2)(f)(iv) is hereby replaced by the following provision:
"5 (2)(f)(iv) the gross leasable floor area of any Retail Store permitted
shall not exceed 5000 square metres."

Clause 5(2)(0 is hereby further amended by adding the following Special
Restrictions:
"5 (2)(f)(v)
No person shall, within the building envelope shown on
Schedule II attached hereto, use any lot or erect, alter or use
any building or structure except in accordance with the
following provisions:
BUILDING LOCATION AND SETBACKS
For the purpose of this clause, the building envelope and build-to-
zone shown on Schedule II attached hereto shall be measured from
the property lines;

No building or portion of a building or structure shall be erected
within the building envelope shown on Schedule II attached hereto,
unless the entire length of the build-to-zone adjacent to Kingston
and Liverpool Roads is occupied by a continuous portion of the
exterior wall of the building, containing the building interior;
No traffic aisles or parking space shall be permitted between the
build-to-zone and the Kingston Road or Liverpool Road rights-of-

Despite the yard requirements of this By-law, any building or portion
of a building erected within the building envelope or build-to zone
shown on Schedule II attached hereto, shall be set back a minimum
of 3.0 metres from the Kingston Road and the Liverpool Road
rights-of-way. A patio, walkways, landscaping and open space shall
be permitted within the required 3.0 metre setback;
Despite the height provisions of this By-law, any building or portion
of a building erected within the building envelope or build-to zone
shown on Schedule II attached hereto shall be of a minimum height
of 6.5 metres and a maximum height of 20 metres."
3. BY-LAW 3036
By-law 3036, as amended, is hereby further amended only to the extent necessary to give
effect to the provisions of this By-law as it applies to the area set out in Schedule II
attached hereto. Definitions and subject matters not specifically dealt with in this
By-law shall be governed by relevant provisions of By-law 3036, as amended.
4. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof, subject to the approval of
the Ontario Municipal Board, if required.
