HomeMy WebLinkAboutBy-law 5710/00THE CORPORATION OF THE CITY OF PICKERING BY-LAW NO. 5710 /00 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended by By-law 5416/98, to implement the Official Plan of the City of Picketing District Planning Area, Region of Durham, in Part of Lot 20, Concession 1 in the City of Picketing. (A 30/99) WHEREAS the Council of the Corporation of the City of Picketing passed By-law 5416/98, amending Zoning By-law 3036, to permit the development of high density residential and mixed uses in Part of Lot 20, Concession 1, in the City of Picketing; AND WHEREAS the Council of the Corporation of the City of Picketing now deems it desirable to amend By-law 5416/98 to extend the "RH/MU-2" Zone onto the northerly-abutting portion of land, being Block 11, Plan 40M-1231, in order to allow it to be developed in conjunction with the southerly-abutting site; AND WHEREAS amendment to By-law 5416/98, which amended Zoning By-law 3036, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOIJDWS: TEXT AMENDMENTS (1) Section 5(2)(ii) (PROVISIONS) Zone Requirements CRH/MU-2" Zone) BUll JDING HEIGHT is amended by adding the following subsection: D Despite subsection B above, no building, part of a building, or structure less than 8.5 metres and 2 storeys in height, or greater than 12 metres and 3 storeys in height shall be erected within the "cross-hatched" area of the "RH/MU-2" Zone on Schedule I attached to this By-law; (2) Section 5(2)(v) (PROVISIONS) Zone Requirements ("RH/MU-2" Zone) SPECIAL REGULATIONS is amended by substituting clause D with the following: D Non-residential uses shall only be permitted within a building containing dwelling units. The non-residential uses shall be limited to the first 2 storeys of a building which has a height of 6 storeys or greater. SCHEDULE AMENDMENT Schedule I to By-law 5416/98 is hereby repealed and replaced by Schedule I attached to this By-law. BY-LAW 3036 By-law 3036, as amended by By-law 5416/98, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule I attached to this By-law. Definitions and subject matters not specifically dealt with in this By-law shall be governed by relevant provisions of By-law 3036, as amended. 2 4. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
