Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to
implement the Official Plan of the Town of Picketing Distric~ Planning Area,
Region of Du~hsm iii Part of Lot 30, Concession I and Block 110, Plan
40M-1473 in the Town of Picketing. {A 23/89; 18T-$9028; A33/89; 18T-89069;
& A31/$9; 18T-89029}
WHEREAS the Council of the Corporation of the Town of Picketing d~*ms: it desirable to
p~,mit the development of detached residential units and semi-detachad residential units to occur
on the subject lands being Pan of LOt 30, Concession I and Block 110, Plan 40M-1473 in the
Town of Picketing;
AND WHEREAS an amendment to By-law 3036, as amended, is therefore deemed neces.sary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF ~ TOWN OF
PICKER[NG HEREBY ENACTS AS FOLLOWS:
Schedule I attached hereto with notations and references shown thereon is hereby declared to
be pan of this By-law.
The provisions of this By-law shall apply to those lands in Pan of Lo! 30, Concession I and
Block 110, Plan 40M-1473, Pickering, designated "SI", "S1E", "S2E", "S4", and "SD-A" on
Schedule I attached hereto.
3. GENERAL PROVISIONS
No building, land or part thereof shall hereafter be used, occupied, erected, moved or
structurally altered excep~/n conformiV7 with the provisions of this By-law.
In this By-law,
(1) (a) ~ shall mean a building or part of a building containing one or more
dwelling units, bm does not include a mobile home or trailer;
(b) ~[h~Alillg_U. ll~ shall mean one or more habitable rooms occupied or capable of
being occupied as a single, independent and separate housekeeping unit containing a
separate kitchen and sanitary facilities;
(c) "Dwelling, Single or Single Dwelling" shall mean a dwelling containing one
dwelling unit and uses accessory thereto;
(d) "Dwelling. Detached or Detached Dwelling" shall mean a single dwelling which is
freestanding, separate and detached from other main buildings or swuctures;
(e) "Dwelling. Semi-Detached or Semi-De~ached Dwelling" shall mean one of a pair of
single dwellings, such dwellings being attached together horizontally in whole or in
pan above grade, below grade, or both above and below grade;

(2) (a) "Floor Area-Residential" shall mean the area of the floor surface contained within the outside walls ora storey or pan ora storey;
CO) "C-ross Floor Area-Residential" shall mean the aggregate of the floor areas of all
storeys of a building or structure, or pan thereof as the case may be, other than a
private garage, an attic or a cellar;
(3) (a) ~Lot' shall mean an area of land fronting on a street which is used or intended to be
used as the site of a building, or a group of buildings, as the case may be, Wgether
with any accessory buildings or strucaues, or a public park or open space area,
regardless of whether or no! such lot constitutes the whole of a lot or block on a
registered plan of subdivision;
CO) ~ shall mean the percentage of lot area covered by all buildings on the
lot;
(c) ~ shall mcan the width of a lot between the side lot lines measured
along a line parallel to and 7.5 metres distant from the front lot line;
(4) ~I/I/Y. glC..C.~:g~ shall mean an enclosed or partially enclosed stngture for the storage of
one or more vehicles, in which structure no business or service is conducted for profit or
otherwise;
(5) (a) ~ shall mean an area of land wMch is appurtenant to and located on the same lot
as a building or structure and is open, uncovered and unoccupied above ground except
for such accessory buildings, structures, or other uses as are specifically permitted
thereon;
Co) ~ shall mean a yard extending across the full width of a lot between the
front lot line of the lot and the nearest wall of the neares~ main building or structure
on the lot;
(c) ~ shall mean the shortest horizontal dimension of a front yard of a
lot between the front lot line and the nearest wall of the nearest main building or
structure on the lot;
(d) ~ shall mean a yard extending across the full width of a lot between the
rear lot line of the lot, or where there is no rear lot line, the junction point of thc side
lot lines, and the nearest wall of the nearest main building or structure on the lot;
(e) ~J~L][IgfLl2C~ shall mcan the shortest horizontal dimension ora rear yard ora lot
between thc rear lot line, or where there is no rear lot line the junction point of the
side lot lines, and the nearest wail of the nearest main building or structure on the lot;
(f) ~ shall mean a yard of a lot ertending from the front yard to the rear yard
and from the side lot line to the nearest wall of the nearest main building or s~ucture
on the lot;
(g) ~;]r,~xl~f~ shall mean the shortest horizontal dimension of a side yard of a lot
between the side lot line and the nearest wall of the nearest main building or structure
on the lot;
Oa) ~fagr.~,~ shall mean a side yard immediately adjoining a street or
abutting on a reserve on the opposite side of which is a street;
(i) "Flanka_~e Side Yard Width" shall mean the shortest horizontal dimension of a
flankage side yard of a lot between the lot line adjoining a sweet or abutting on a
reserve on the opposite side of which is a sweet and the nearest wall of the nearest
main building or structure on the lot;
(j) ~ shall mean a side yard other than a flankage side yard.
O) (a) (*si* zone)
No person shall within the lands designated *SI* on Schedule I attached hereto usc
any lot or erect, alter or use any building or s~ucture for any pm'pose except thc
following:
(i) detached dwelling residential use
(b) ~ (~S1 ~ Zone)
No person shall within the lands designated ~S1~ on Schedule I a~,ached hereto use
gay lot or erect, alter or use gay buildiul~ except ~ accordance with the following
provisions:
(i) LOT AREA (minimum): 400 square meu'es
(ii) LOT FRONTAGE (minimum): 13.5 metres
(iii) FRONT YARD DEPTH (minimt.ll~): 4.$ metres
(iv) INTERIOR SIDE YARD WIDTH:
A minimum 1.2 metres each side, or
B Ilminimtlm ! .8 metres one side and no miniraUlTl other side.
(v) FLANY~OE SIDE YARD WIDTH
(minimuxri): 2.7 meu-es'
(vi) REAR YA_RD DEPTH (minimum): 7.5 me.es
(vii) LOT COVERAOE (maximum): 38 percent
(viii) BUILDINO HEIOHT (maximum): 12 meffes

(x) PARCO REQU]P-,.EML~'NTS: minirflum one
private garage per lot attached to the main building, gay vehicular enlrance of
which shall be located not less than 6.0 meues from the front lot line and no~
less than 6.0 me.es from any side lot line immediately adjoining a street or
abutting on a reserve on the opposite side of which is a street.
(xi) SPECIAL REOULATIONS: the horizontal
distance between buildings on adjacent lots shall not be less than 1.2 melres.
(2) (a) ~ ("SlE" Zone)
No person shall ~thin the lands designated "S1E" on Schedule I attached hereto use
gay lot or erect, alter or use gay building or structure for gay purpose except the
following:
(i) de~ached dwelling residential use

(b) Z~ ('$1E' Zone)
No person shall within the lands designated "S1E" on Schedule I attached hereto use
any lot or erect, alter or use any building except in accordance with the following
provisions:
(i) LOT AREA (minimum): 350 square metres
(ii) LOT FRONTAGE (minimum): 12 metres
(iii) FRONT YARD DEPTH (minimum): 4.5 metres
(iv) INTERIOR SIDE YARD WIDTH:
A mi~½mtlm 1.2 mell~s ellch side, or
B ' minimum 1.1~ metres one side and no minimum other side.
(v) FLANKAGE SIDE YARD WIDTH (m. inimum): 2.7 melres
(vi) REAR YARD DEPTH (minimum): ?.5 melzes
(vii) LOT COVERAGE (maximum): 38 percent
(viii) BUILDING HEIGHT (maximum): 12 melres

(3) (a) ~ CS:E" Zone)
No person shall within the lands designated 'S2E" on Schedule I attached hereto use
any io! or erect, alter or use any building or structure for any purpose except the
following:
(i) detached dwelling residential use
(b) ("S2E' Zone)
No person shall wilhin the lands designated 'S2E~ on Schedule I attached hereto use
any lot or erect, alter or use any building excep! in accordance with the following
provisions:
(i) LOT AREA (minimum): 300 square mea'es
(ii) LOT FRONTAGE (minimum): 10 metres
(iii)FRONT YARD DEPTH (minimum): 4.5 metres
(iv) INTERIOR SIDE YARD WIDTH:
A mlnlm~ll~ ] .2 metres one side, 0.6 metres other side, or

(I) a~ least 1.2 me1~es interior side yard width is provided to the nearest
wall of a private garage, and

any lot or erect, alter or use any building or slructure for any purpose except the
following:
(i) de~ached dwelling residential use
(b) ~ ("S4" Zone)
No pe~on shall within the la~ds desig~ted ~S4" on Schedule I a~hed hereto use
any lot or erect, alter or use any building except in accordance with the following
provisions:.
(i) LOT AREA (~inlmum): 250 square metres
(ii) LOT FRONTAGE (minimum): 9 metr~
(iii) FRONT YARD DEPTH (minimum): 4.5 metres
(iv) INTERIOR SIDE YARD WIDTH:
A minimum 1.2 me~es one side and 0.6 metres other side, or
B no minimum one side so long as on the other side,
(Y) at least ! .2 metres interior side yard width is provided to the neares~ wall
of a private garage, and

(I0a! least !.8 metres interior side yard width is pwvided to any other wall
of the main dwelling.
(v) FLANKAGE SIDE YARD WIDTH:
A lots abutting Finch Avenue or a reserve on the
opposite side of which is Finch Avenue (mlnlmtlm): 4.5 meffes

(5) (a) ~ ('SD-^~ Zone)
No person shall within the lands desi~ated 'SD-A" on Schedule I attached hereto,
use any lot or erect, alter or use any building or structure for any purpose except the
following:
(i) semi-detached dwelling residential use
Co) ~ ("sD-^~ Zone)
No person shall within the lands designated nSD-A~ on Schedule I attached hereto,
use any lot or erect, alter or use any building except in accordance with the following
provisions:
(i) LOT AR~A (minimum): 225 square me.es
(ii) LOT FRONTAGE (minimum): 7.5 meU'es
(iii)FRONT YARD DEPTH (minimum): 4.5 me.es
(iv) INTERIOR SIDE YARD WIDTH: 1.2 mcu~s except
that no interior side yard shall be provided on the side where dwellings are
attached together, so long as every common wall extending along the side lot
line separating such lots, or that is not a direct extension thereof, shall be set
back f~om the side lot line as follows:
A1.2 metres measured perpendicularly to such side lot line if no abutting side
yard is provided on the abutting lot, or
B0.6 metres measured perpendicularly to such side lot line if an abut'ting side
yard is provided on the abutting lot.

(v) FLANKAGE SIDE YARD WIDTH (minimum): 2.7 meu~s

(x) PARKING REQUIREMENTS: minimum one

(xi) SPECIAL REGULATION:
A the horizontal distance betw~n buildings on adjacent lots, except where

B despite the definition of ~Dwelling, Semi-Detached or Semi-Detached
Dwelling" in Sectioll 4.(lXe), Semi-Detached Dwellings ere~-'ted ill an ~SD-
A' zone shall be attached above grade by a private garage common wall
which shall be not less than 3 metres in length and not less than 2.4 melres
in height.
By-law 3036, as amended, is hereby further amended only to the extent necessary to give
effect to the provisions of this By-law as it applies to the area set out in Schedule I attached
hereto. Definitions and subject matters not specifically denlt with in this By-law shall be
governed by the relevant provisions of By-law 3036, as amended.
This By-law shall take effect fi.om the day of approval of the Ontario Municipal Board.
