Being a by-law to stop-up and close Penny Lane, Plan
M-997, Pickering, as public highway and to authorize
the sale of parts thereof and of Block Xtt, Plan M-997,
Pickering, to the abutting owners.
WHEREAS, pursuant to section 263 of the Municipal Act, R.S.O. 1990, c. M.45, since jurisdiction over
it has not been expressly conferred upon another council, the Council of The Corporation of the Town
of Picketing has jurisdiction over Penny Lane, Plan M-997, Pickering, and consequently, pursuant to
section 262(I) of the Act, the soil and freehold thereof is vested in The Corporation of the Town of
Pickering; and
WHEREAS, pursuant to sections 191(1), 297(1)(c), 297(1)(d) and 315 of the Act, the Council of The
Corporation of the Town of Picketing may pass by-laws to stop up a highway or part thereof and to
authorize its sale or the sale of a part thereof at a fixed price; and
WHEREAS The Corporation of the Town of Pickering is the owner of Reserve Block XH, Plan M-997,
Picketing, portions of which it no longer requires for municipal purposes; and
WHEREAS, pursuant to section 191(1) of the Act, the Council of The Corporation of the Town of
Picketing may pass by-laws to dispose of lands owned by it when those lands are no longer required for
,nunicipal purposes;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. (1) That part of Penny Lane, Plan M-997, Pickering, designated as Parts 2, 3, 7, 8 and 10,
Plan 40R~10192, is hereby stopped up and closed to both vehicular and pedestrian
traffic.
(2) That part of Penny Lane, Plan M-997, Pickering, designated as Part 4, Plan 40R-10192,
is hereby stopped up and closed to vehicular traffic only.
2. The Corporation of the Town of Picketing shall dispose of a sanitary sewer easement to the
Regional Municipality of Durham over those parts of Penny Lane, Plan M-997, Picketing,
designated as Parts 2, 4 and 7, Plan 40R-10192, and over those parts of Block XH, Plan M-997,
Pickering, designated as Parts 1.5 and 6, Plan 40R- 10[92, at a sale price of $2.00;
3. (I) Those parts of Penny Lane, Plan M-997, Pickering, designated as Parts 2 and 3, Plan
40R~10192, and that part of Block XH, Plan M-997, Picketing, designated as Part 1,
Plan 40R-10192, shall be offered for sale to the abutting owner to the south, subject to
an easement in favour of the Regional Municipality of Durham over Parts I and 2, Plan
40R-10192, for the sale price of $2.00.
(2) That part of Penny Lane, Plan M-997, Pickering, designated as Part 10, Plan
40R-10192, shall be offered for sale to the abutting owner to the north, at a sale price of
$2.OO.
(3) Those parts of Penny Lane, Plan M-997, Picketing, designated as Parts 7 and 8, Plan
40R-10192, and those parts of Block XH, Plan M-997, Picketing, designated as Pans 6
and 9, Plan 40R-10192, shall be offered for sale to the abutting owner to the north,
subject to an easement in favour of the Regional Municipality of Durham over Parts 6
and 7, Plan 40R-10192, for the sale price of $70,000.
4. (1) The offers referred to in section 3 shall be made by the Town on or before January 31,
1993.
(2) The period within which an abutting owner may exercise the right to purchase the lands
offered in any offer under section 3 shall commence at 9:00 a.m. on February 1, 1993
and end at 4:00 p.m. on March 1, 1993.
5. The Mayor and Clerk are hereby authorized to execute any documents approved by the Town
Solicitor and r~quired to effect the dispositions, offers and transfers provided for in this By-law.

BY-LAW read a third time and finally passed this 21st day of December, 1992.
