BY-LAW NO. 4068/92
Being a by-law to authorize the execution of a Release
and Discharge of the Subdivision Agreement respecting
Plans 40M-1466 and 40M-1467, Pickering.
WHEREAS, puxsuant to the Planning Act, R.S.O. 1990, Chap. P.13, s.51, The Corporation of the Town
of Picketing and John Boddy Developments Ltd. entered into an Agreement dated July 2, 1985, Notice
of which was registered on May 7, 1987 as Instrument No. LT323412, respecting the subdivision and
development of Plans 40M-1466 and 40M-1467, Picketing; and
WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of
the Town;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form
attached hereto as Schedule A, of the Agreement dated July 2, 1985, Notice of which was
registered May 7, 1987 as Instrument No. LT323412, between John Boddy Developments Ltd.
and The Corporation of the Town of Pickering, respecting the subdivision and development of
Plans 40M-1466 and 40M-1467, Pickering.
2. Schedule A hereto forms part of this By-law.
BY-LAW read a first, second and third time and finally passed this 4th day of August, 1992.

RELEASE AND DISCHARGE
WHEREAS the Agreement dated July 2, 1985, Notice of which was registered May 7, 1987, in the Land
Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT323412, between,
JOHN BODDY DEVELOPMENTS LTD.
hereinafter referred to as the "Company"
THE CORPORATION OF THE TOWN OF PICKEKING
hereinafter referred to as the "Town",
provided for the subdivision and development of lands affected hereby; and
WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of
the Town with respect to the lands affected hereby;
THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and
assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind
whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions
of the Agreement.
THIS RELEASE AND DISCHARGE affects the lands described as:
Lots 1-161, inclusive, Lots 168 and 169, Blocks 170~176, inclusive and Heathside Crescent, Longbow
Drive and Rambleberry Avenue, Plan 40M-1466 and Lots 1-130, inclusive, Blocks 131-135, inclusive,
Kelvinway Lane and Rambleberry Avenue, Plan 40M-1467, Town of Pickering, Regional Municipality
of Durham.
IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly
authorized officers.
