BY-LAW NUMBER 4062/92
Being a By-law to amend Restricted Area (Zoning) By-law 2511, as amended, to
implement the Official Plan of the Town of Picketing District Planning Area,
Region of Durham, in Part of Lot 28, Range 3, B.F.C., in the Town of
Pickering. (A 5/92)
WHE~ the Council of the Corporation of the Town of Pickerini[ deems it desirable to
permit the establishment of a gasoline retail outlet (gas bar) on the subject lands, being Part of
Lot 28, Range 3, B.F.C., in theTown of Pickering;
AND WHEREAS an amendment to By-law 2511, as amended, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. By-law 2511 passed by the Council of the Corporation of the Township (now Town) of
Plckering on the 5th day of October, 1960, and approved by the Onta. rio Municipal
Board on the 3rd day of January, 1963, and amended from time to time, is hereby
further amended to the extent necessary to give effect to the provisions of Sections 2
and 3 hereof.
2. TEXT AMENDMENT~
(1) Section 2 of the said By-law is hereby further amended by adding thereto the
following subsection:
2.37.1 GASOLINE RETAIL OUTLET
"Gasoline Retail Outlet" shall mean an establishment where only fuel
sales, lubricants and accessories are offered for retail sale, but shall not
include an establishment engaged in repairing or painting vehicle bodies.
(2) Section 14 of the said By-law is hereby further amended by adding thereto the
following subsection:
14.4.2 Part of Lot 28, Range 3, B.F.C.
Despite ,t, he provisions of Section 14.1 hereof, the lands designated
"C2/GS3 on Schedule "A" hereto and located in Part of Lot 28,
Range 3, B.F.C., may .not be used for the purposes of an automobile
serace, station, but may be used for the purposes of a gasoline retail
outlet m accordance with the provisions of Sections 14.2 and 14.3 hereof.
3. SCHEDUI.E 'A' AMENDMENT
Schedule "A" to By-law 2511, as amended, is hereby further amended by altering
from 'C2' t,o 'C2/GS3" the zone designation of the lands designated 'C2~GS3" on
Schedule "I' attached hereto and located in Part of Lot 28, Range 3, B.F.C., in the
Town of Pickering.

By-law 2511, as am. ended, is hereby further .amended only to the extent necessary to give
effect to the provisions .of this By-law as ~t applies to the area set out in Schedule I
attached hereto. Definitions and subject matters not specifically dealt with in this By-law
shall be governed by the relevant provisions of By-law 2511, as amended.
5. ENFORCEMENT
(1) Any person who contravenes any of the provisions of this By-law is guilty of an
offence and on conviction is liable,
(a) on a first conviction to a fine of not more than $20,000; and
(b) on a subsequent conviction to a fine of not more than $10,000 for each day or
part thereof upon which the contravention has continued after the day on
which he was first convicted.
(2) Where .a corpora?on is convicted under subsection (1), the maximum penalty that
may be ~mposed ~s,
(a) on a first conviction a fine of not more than $50,000; and
(b) on a subsequent conviction a fine of not more than $25,000 for each day or part
thereof upon which the contravention has been continued after the day on
which the corporation was first convicted;
and not as provided in subsection (1).
(3) Where a conviction is entered under subsection (1), in addition to any other remedy
or penalty by law, the court in which the conviction has been entered, and any court
of competent jurisdiction thereafter, may make an order prohibiting the
continuation or repetition of the offence by the person convicted.
6. EFFECWIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.
