Being a Zoning By-law to amend By-law 2497/87, which amended Restricted Area
(Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of
Pickering District Planning Area, Region of Durham, in Part of Lot 19, Plan 230, in
the Town of Pickering. (OPA 91-P/2)(A14/91)
WHEREAS the Council of the Corporation of the Town of Pickering passed By-law 2497/87,
amending By-law 3036, to permit the establishment of restricted light industrial uses and a
greenbelt-conservation area on lands being Part of Lot 19, Plan 230, Town of Pickering.
AND WHEREAS the Council of the Corporation of the Town of Pickering passed By-law
2969/88 which amended By-law 2497/87 to also permit the establishment of offices, financial
institutions, restaurants - type A,. furniture and major appliance stores, home improvement
centres, light machinery and eqmpment suppliers and rental establishments on lands being
Part of Lot 19, Plan 230, Town of Pickering.
AND WHEREAS the Council of the Corporation of the Town of Pickering now deems it
desirable to further amend By-law 2497/87, as amended, to also permit the establishment of
private non-residential schools and day nurseries on lands being Part of Lot 19, Plan 230,
Town of Pickering.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. Section 4. of By-law 2497/87, as amended, is hereby further amended by adding
thereto the following definitions:
(36) "Day Nursery" shall mean lands and premises duly licenced pursuant to the
pro,~isions of the Day Nurseries Act, R.S.O. 1990, c. D.2, or any successor
thereto, and for the use as a facility for the daytime care of children.
(37) "Private Non-Residential School" shall mean a school which is maintained for
educational or religious purposes but shall not include any other school
defined herein.
(38) "Private Residential School" shall mean a school which is maintained for
educational or religious purposes and which includes accessory residential
facilities but shall not include any other school defined herein.
(39) "Public School" shall mean,
(i) a school under the jurisdiction of a Board of Education which Board is
continued or established pursuant to the Education Act, R.S.O. 1990,
c. E.2, or any successor thereto;
(ii) a college of applied arts and technology continued or established
pursuant to the Ministry of Colleges and Universities Act, R.S.O. 1990,
c. M.19, or any successor thereto; and
(iii) a university eligible to receive provincial funding pursuant to the
Ministry of Colleges and Universities Act, or any successor thereto.
2. Section 5.(4)(a) of By-law 2497/87, as amended, is hereby further amended by
adding thereto the following:

3. Section 5(4)(h)(ii) of By-law 2497/87 is hereby amended by adding the following to
it:
except that, where any of the uses in operation on the lands is a private
non-residential school or a day nursery, there shall be provided and maintained on
the lot a minimum of 20 parking spaces only.
4. BY-LAW 2497/87
By-law 2497/8.7, as amended, is hereby further amended only to the extent
necessary to give effect to the provisions of this By-law. Definitions and subject
matter not specifically dealt with in this By-law shall be governed by the relevant
provisions of By-law 2497/87, as amended, and By-law 3036, as amended.
5. EFFECTIVE DATE
This By-law shall take effect from the dayof passing hereof, subject to the approval
of Amendment No. 75 to the Pickering District Plan by the Minister of Municipal
Affairs, and subject to the approval of the Ontario Municipal Board, if required.
