HomeMy WebLinkAboutBy-law 4022/92 THE CORPORATION OF THE TOWN OF P!CKER1NG By-LAW NQ. 4022/92__ Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agreement, and amendments thereto, respecting Plan 40M-1442, Pickering. WHEREAS, pursuant to the Planning Act R.S.O. 1990, Chap. P.13, s.51, The Corporation of the Town of Picketing and Cougs Investments Ltd. entered into an Agreement dated June 30, 1986, Notice of which was registered on January 14, 1987 as Instrument No. LT305627, respecting the subdivision and development of Plan 40M-1442, Picketing, which Agreement was subsequently amended by an unregistered Agreement between the Town of Pickering and Cougs Investments Ltd. and Alexander Dixon, dated May 2, 1988; and WHEREAS the terms and conditions of that Agreement, as amended, have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreement dated June 30, 1986, Notice of which was registered January 14, 1987 as Instrument No. LT305627, between Cougs Investments Ltd. and The Corporation of the Town of Picketing, as amended by the unregistered Agreement between Cougs Investments Ltd. and Alexander Dixon and The Corporation of the Town of Pickering dated May 2, 1988, respecting the subdivision and development of Plan 40M-1442, Picketing. Schedule A hereto forms part of this By-law. R~ELEASE AND DISCHARQ~_ WHEREAS the Agreement dated June 30, I986, Notice of which was registered January 14, 1987, in the Land Registry Office for the Land Titles DivLsion of Durham (No. 40) as Instrument No. LT305627, between, COUGS INVESTMENTS LTD. hereinafter referred to as the "Company" - and - THE CORPORATIO~N__OF THE TOWN Qa~_PICKERINQ_ hereinafter referred to as the "Town", as amended by the unregistered Agreement dated May 2, 1988, provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement, as amended, have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of both Agreements. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 144, Blocks 45-59, Plan 40M-1442 and Block 160, Plan 40M-1437, Town of Pickering, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this 15th day of June, 1992.
