BY-LAW NUMBER 4342/93
Being a By-law to adopt Modified Amendment Number 79 to the District Plan for
the Town of Picketing (OPA 92-007/P)
WHEREAS pursuant to the Planning Act, R.S.O. 1990, chapter P. 13, subsections 17(6) and
21(1), the Council of the Corporation of the Town of Picketing may by by-law adopt amendments
to the District Plan for the Town of Pickering. being an official plan, and submit them to the
Minister of Municipal Affairs for approval; and
WHEREAS the Council of the Corporation of the Town of Pickering passed by-law 4092/92
adopting Amendment Number 79 to the Picketing District Plan (Highbush Community Plan) for
lands known as the Altona Forest Area; and
WHEREAS the Ministry of Municipal Affairs has referred Amendment Number 79 to the Ontario
Municpal Board; and
WHEREAS modifications to Amendment Number 79 are necessary to reflect the Metropolitan
Toronto and Region Conservation Authority's Project for the Acquisition of the Altona Forest
Environmentally Significant Area and land use changes related thereto, and to address other
changes conveyed by the Ministry of Municipal Affairs;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. Modified Amendment Number 79 to the District Plan for the Town of Pickering, attached
hereto as Exhibit "A" and including the Explanatory Text, is hereby adopted.
2. The Clerk of the Town of Pickering is hereby authorized and directed to submit Modified
Amendment Number 79 to the District Plan for the Town of Pickering to the Ministry of
Municipal Affairs and to the Ontario Municipal Board for their information and respective
approval where appropriate.
3. By-law 4079/92 is hereby repealed.
4. This By-law shall come into force and take effect on the day of the final passing hereof.
By-law read a first, second and third time and finally passed this 15th day of
November , 1993.

TO THE
TOWN OF PICKERING DISTRICT PLAN
PART 1 AND THE HIGHBUSH COMMUNITY PLAN
MODIFIED AMENDMENT NO. 79 TO THE PICKERING DISTRICT PLAN
Part I and the Highbush Community Plan
PURPOSE: The purpose of this amendment is to change the current land use
designations and policies of the Highbush Community Plan as follows: to
identify as major open space, a large forested area intended for public
acquisition and conservation; to permit on lands surrounding the forested
area, low and medium density residential uses, community uses including
elementary schools and parks, and open space uses; and to extend the
community boundary at the northeast comer of the community. The
amendment also deletes the northerly major collector road between
Rosebank Road and Altona Road from the Roads Plan.
LOCATION: The subject lands are approximately 130 hectares (330 acres) in size.
They comprise a block of land bounded by Rosebank Road, the CN Rail
line, Altona Road and the Ontario Hydro Corridor.
The lands are generally described as Part of Lots 31 and 32, Concession 1,
in the Town of Picketing.
BASIS: The amendment has been determined to be appropriate following the
provincial approval of the Metropolitan Toronto and Region Conservation
Authority's Project for the Acquisition of the Altona Forest
Environmentally Significant Area, the completion by the Town of a land
use study that was undertaken commencing in 1987, and the completion
by the Town of Phase I of the Altona Forest Environmental Management
Study in 1990.
This amendment provides opportunities for the Town, the Region and the
Province to fulfill various ecological, social and economic objectives
through public acquisition of a significant forest in the urban area and
completion of the Highbush Community. The amendment improves upon
the existing official plan by highlighting an extensive area of forest for
public acquisition, and expressing the Town's support for the long term
management of these lands.
ACTUAL The Town of Pickering District Plan (Part I and the Highbush Community
AMENDMENT: Plan) is hereby amended by:
Substantive Amendments to tho Highbush
(i) Add a new subsection (g) in section 1. GOALS, as follows:
1.(g) To acquire in public ownership a significant forested
area within the community for purposes such as
conservation, education and passive recreation.

(ii) Replace the existing subsections (a) and (b) of section 2.E., Open
Space System, with new subsections (a) and (b), as follows:
2.E.(a)Lands designated on Schedule V-A as Major Open
Space, which may include hazard lands, recognize
important natural features in the Highbush
Community.
2.E.(b)Lands designated as Major Open Space shall be
retained primarily in their natural state and used only
for purposes such as conservation, education, passive
recreation, or pedestrian and bicycle paths.
(iii) Replace the existing subsection (d) of section 2.E., Open Space
System, with a new subsection (d) as follows:
2.E.(d)Additional policies governing certain of the lands
designated Major Open Space are contained in section 5
of this Community Plan.
(iv) In the first sentence of subsection (g) of section 2.E., Open Space,
delete the phrase "and Open Space" and delete the letter "s" from
the word "designations" so that the sentence reads as follows:
2.E.(g)The actual boundaries of the Major Open Space
designation and the extent of the hazard lands shall be
determined more exactly in consultation with the
Metropolitan Toronto and Region Conservation
Authority and the Ministry of Natural Resources during
the review of development applications.
(v) Add a new subsection (c) in section 2.F., Callllllllaily_[J~, after
the introductory paragraph, as follows:
2.F.(c) The Community Uses area, located on the west side of
Rosebank Road, is intended to accommodate a
neighbourhood park, a public elementary school and a
separate elementary school. A church may also be
permitted in this area.
(vi) Add a new subsection (d) in section 3., ROADS AND
PEDESTRIAN WALKWAYS, as follows, and renumber and re-
order the existing subsection 3.(c) as 3.(e):
3.(d) Where major roads cross creek valleys, the design and
construction of such roads shall be of a high
environmental standard so as to minimize impacts on
the natural features and systems of the area. Also,
consideration shall be given to incorporating, where
feasible, pedestrian undercrossings into the design of
major roads to provide continuous pedestrian linkages
along open space corridors.

(vii) Add a new subsection B. in section 4., SPECIAL POLICY AREA,
as follows:
An area located on the west side of Rosebank Road
north of the Canadian National Railway line, containing
a number of parcels under separate ownership, is
identified as Special Policy Area B. Development shall
proceed in accordance with a Council adopted road
pattern for the Special Policy Area B.
(viii) Replace the existing section 5., ENVIRONMENTAL POLICY
AREA, in its entirety, with the following:
5. ENVIRONMENTAL POLICY AREA
A. Acquisition Area
(a) Lands containing areas of high environmental
significance and sensitivity are identified on
Schedule V-A as an Environmental Policy Area.
Approximately half of this Area is to be acquired
by the Metropolitan Toronto and Region
Conservation Authority for long term
conservation purposes. These acquired lands are
known as the AItona Forest, the Petticoat Creek
and its tributary.
(b) The lands to be acquired as part of the AItona
Forest are designated Major Open Space and
generally lie north of the Major Collector Road.
Lands to be acquired as part of the Petticoat
Creek and its tributary are designated Major
Open Space and generally lie south of the Major
Collector Road.
(c) In addition to the uses specified in section 2.E.(b)
of this Community Plan, other uses may be
permitted on lands designated Major Open
Space in accordance with the Environmental
Management Plan prepared for the Altona
Forest, which Plan also has regard for the
Petticoat Creek and its tributary.
(d) Prior to submitting development proposals for
any lands within the Environmental Policy Area,
proponents are encouraged to consult with the
Metropolitan Toronto and Region Conservation
Authority, and the Ministry of Natural
Resources, to determine whether the lands are
within the area to be acquired as part of the
AItona Forest, the Petticoat Creek and its
tributary.

B. Residential Uses
(a) Outside the acquisition area, lands for residential
development are designated Residential Low
Density I & II, and Residential Medium
Density I & II on Schedule V-A.
(b) Residential uses may be permitted within the
density ranges defined by the Residential
provisions as set out in Part I of the Picketing
District Plan, and in accordance with the
provisions of the Land Use Planning for Housing
Policy Statement requiring the opportunity for at
least 25 % affordable units. For lands
designated Residential Medium Density I & Il,
the exact density permitted within the allowable
range will be subject to site constraints and the
availability of adequate servicing capacity.
(c) The Residential designations create the
opportunity for a broad range and mix of
housing types which are suitable for residents
with varying income levels, ages, lifestyles and
household structures. A selection of dwelling
units with varying unit sizes, bedroom counts,
built form, tenure and affordability is desired.
Innovative housing types and zoning standards
are encouraged to ensure that the development
will create and foster continuing opportunities
for affordable housing.
C. Design
(a) The Major Collector Road has been designated
in a location to provide both short and long
distance views of the Altona Forest.
(b) The design of specific proposals shall be
consistent with the Environmental Management
Plan for the AItona Forest, which Plan also has
regard for the Petticoat Creek and its tributary.
D. Supporting Documentation
(a) Within the Environmental Policy Area and at the
discretion of the Town in consultation with
relevant authorities, applications for
development shall be accompanied by an
Environmental and Engineering Report. The
Report shall outline the potential impacts of the
development on the Altona Forest and the valley
lands, and shall describe mitigating measures
and management strategies intended to alleviate
potential negative impacts and maintain
potential positive impacts of the development on
the AItona Forest, the Petticoat Creek and its
tributary.

E. Implementation
(a) The Town, in consultation with relevant
authorities, may require a comprehensive
stormwater management strategy to be
undertaken for the Environmental Policy Area.
(b) Within the Environmental Policy Area, the Town
recognizes the existence of four distinct
development areas separated from each other by
the Altona Forest and the valley lands. Prior to
site development within a particular
development area, the Town, in consultation with
relevant authorities, may require a proponent to
submit a detailed stormwater management
report for that entire development area. The
report shall demonstrate compliance with the
comprehensive strategy prepared for the
Environmental Policy Area, to the satisfaction of
the Town in consultation with relevant
authorities.
(c) Prior to development and at the Town's
discretion, in consultation with relevant
authorities, proponents may be required to
submit a Construction Management Report to
the Town. The Report shall outline site
management measures to be undertaken during
construction to control construction debris,
prevent erosion and sedimentation, direct
construction traffic, ensure public safety, and
address other matters as required.
(d) Subdivision and development agreements for
lands within the Environmental Policy Area may
specify appropriate mitigating measures and
management strategies for the development of
the lands.
(e) The Town shall assist the Metropolitan Toronto
and Region Conservation Authority in the
development, implementation and maintenance
of the Environmental Management Plan to
achieve the long term conservation of the Altona
Forest and valley lands. The Town supports an
Environmental Management Plan that includes
environmental monitoring to provide for
continued review of the Forest and valley land
conditions. Also, the Town supports an
Environmental Management Plan that includes
community involvement to enable public
education and input.

(ix) Amend Schedule V-A as outlined on Exhibit "A" and Exhibit "B"
to this Amendment and described on Exhibit "B-l":

District Plan as outlined on Exhibit "C" to this Amendment:

(i) In subsection (c) of section 2.B, l~c,~[edllial, pluralize the phrase
"Special Policy Area" and insert the words "in the" before the
phrase "Environmental Policy Area" so that the subsection reads as
follows:
2.B.(c) Supplementary policies that apply to proposed
residential development located in the Special Policy
Areas and in the Environmental Policy Area are
provided in sections 4 and 5 respectively of this
Community Plan.
(ii) Replace the first two sentences of the introductory paragraph of
section 2.F., ~ with the following sentence and
number the paragraph as subsection (b):
2.F.(b)The Community Uses area located on the west side of
Whites Road, south of Finch Avenue, is intended to
accommodate a high school and municipal recreation
complex.
(iii) Add a new subsection (a), to section 2.F., ~ as
follows:
2.F.(a) Community Uses areas are designated on Schedule V-A.
Lands designated Community Uses are intended to
accommodate facilities such as schools, parks and
recreation centres.
(iv) In section 2.F., C.9.1~, number the sentence that begins
"If the school board and~or the municipality ..." as subsection (d).
(v) In section 2.F., .C,~, number the paragraph that
begins "With the exception of the high school site ..." as
subsection (e).
(vi) In section 3., ROADS AND PEDESTRIAN WALKWAYS,
number the sentence that begins "The privacy of adjacent residents
and the character of the surroundings ..." as subsection (c).

(vii) Pluralize the title of section 4., SPECIAL POLICY AREA, so that
is reads as follows:

add a new subtitle and number the section 4.A., as follows:

Redesignate land uses and collector mad network as illustrated on Exhibit "B" to Modified
Amendment No. 79 to the Pickering District Plan (Part I and the Highbush Community Plan) as
described as follows:
(a) expand Environmental Policy Area to encompass all lands within the block bounded by
Rosebank Road, the CN Rail line, Altona Road and the Ontario Hydro Corridor;
(b) delete Community Park symbols and establish Major Open Space designation over
central and northern portions of the community to represent the Altona Forest;
(c) change the designation of the valley of the tributary of Petticoat Creek from Open Space
to Major Open Space;
(d) delete the existing symbol for the public school/neighbourhood park/ separate school
complex; designate Community Uses area east of the Major Open Space lands, north of
the southerly Major Collector Road; establish individual symbols for each of the public
school, the neighbourhood park, and the separate school within the Community Uses
area;
(e) redesignate residential lands between Rosebank Road and the Major Open Space lands as
Residential Low Density I & II; mdesignate the lands in the southwest portion of the
block as Residential Low Density I & II; redesignate lands between the two blocks of
Major Open Space as Residential Medium Density I & II; redesignate lands in the
northwest portion of the block as Residential Medium Density I & II;
(O remove fill line illustrated within the Environmental Policy Area;
(g) establish Special Policy Area B in southeast sector of block;
(h) realign southerly Major Collector Road to intersect Altona Road in a more southerly
location;

(k) delete the remaining Minor Collector Roads and establish new ones accessing Rosebank

Boundary to incorporate the surplus hydro lands in the northeast comer of the block, and
establish a Major Open Space designation on the lands.
