BY-LAW NO. 4205/93
Being a by-law to authorize the execution of a Transfer
of Easement from Highbush-Rougemount Centre Inc. to
The Corporation of the Town of Picketing over Part Lot
170, Plan 816, Picketing (Part 8, Plan 40R-14623), and
porn Woodlands-Rougemount Centre Inc. to The
Corporation of the Town of Picketing over Part Lot 6,
Plan 228, Picketing (Part 12, Plan 40R-14623) and Part
Lot 169, Plan 816, Pickering (Part 5, Plan 40R-14625)
[S6/91].
WHEREAS, as a condition of Site Plan approval pursuant to the provisions of section 41 of the
Planning Act, R.S.O. 1990, Chap. P. 13 (S6/91), The Corporation of the Town of Picketing requires
access easements over Part Lot 170, Plan 816, Picketing (Part 8, Plan 40R-14623), Part Lot 6, Plan 228,
Picketing (Part 12, Plan 40R-14623) and Part Lot 169, Plan 816, Picketing (Part 5, Plan 40R-14623) for
the purpose of providing access between Kingston Road and Part Lot 6, Plan 228, Picketing (Parts 2, 3,
4, 5 and 6, Plan 40R-10643), and
WHEREAS, pursuant to the provisions of section 191 of the Municipal Act, R.S.O. 1990, Chap. M.45,
the Council of The Corporation of the Town of Picketing may pass by-laws for acquiring interests in
lands;
NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
I. The Mayor and Clerk are hereby authorized to execute a Transfer of Easement, in the form
attached hereto as Schedule A, from Highbush-Rougemount Centre Inc. to The Corporation of
the Town of Picketing over that part of Lot 170, Registrax's Compiled Plan 816, Picketing,
designated as Part 8, Plan 40R-14623.
2. The Mayor and Clerk axe hereby furlher authoxized to execute a Transfer of Easemem, in the
form attached hereto as Schedule B, from Woodlands-Rougemotmt Centre Inc. to The
Corporation of the Town of Picketing over,
(a) that part of Lot 6, Plan 228, Picketing, designated as Part 12, Plan 40R-14623,
(b) that part of Lot 169, Registrax's Compiled Plan 816, Picketing, designated as Part 5,
Plan 40R-14623.
BY-LAW read a first, second and third time and finally passed this 19th day of April, 1993.

]NATURE OF EASEMENT TRANSFERRED
1. The free, uninterrupted and unobstructed right and easement for the Transferee, its successors
and assigns, and its and their agents, employees, contractors, tenants, invitees, licensees,
customers, clients and patrons to use the lands described in Box 5 for the purpose of
pedestrian and vehicular access, both ingress and egress, between Kingston Road and that part
of Lot 6, Plan 228, Picketing, comprising Parts 2, 3, 4, 5 and 6, Plan 40R-10643.
2. The Transferor covenants that it shall not erect any building or structure nor place or remove
any fill on or from any p',u't of the lands without the express written consent of the Transferee.
3. The Transferor hereby releases the Transferee from any claim which may arise out of the
exercise by the Tr,,msferee of the right and easement granted hereby.
4. The Transferor covenants that it shall execute such further assurances of the right and
easement granted hereby as may be required by thc Transferee.
5. The burden of this Transfer and of all the covenants contained herein shall run with the lands
herein described.
6. This Transfer shall be binding upon and shall enure to the benefit of the parties hereto and
their respective successors and assigns.
