HomeMy WebLinkAboutBy-law 4192/93 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 4192/93 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agreement respecting Plans 40M-1272, 40M-1533, 40M-1400 and 40M~1591, Pickering. WHEREAS, pursuant to the Planning Act R.S.O. 1990, Chap. P.13, s.51, The Corporation of the Town of Pickering and Runnymede Development Corporation Limited entered into an Agreement dated April 18, 1983, Notice of which was registered on August 16, 1983 and again on November 16, 1984 as Instrument No. LT181623 and LT219845, respecting the subdivision and development of Plans 40M-1272, 40M-1333, 40M-1400 and 40M-1591, Picketing; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: 1. The Mayor and Clerk axe hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A and Schedule B, of the Agreement dated April 18, 1983, Notice of which was registered August 16, 1983 and again on November 16, 1984 as Instrument No. LT181623 and LT219845, between Runnymede Development Corporation Limited and The Corporation of the Town of Picketing, respecting the subdivision and development of Plans 40M- 1272, 40M- 1333,40M- 1400 and 40M- 1591, Pickering. 2. Schedules A and B hereto form part of this By4aw. BY-LAW read a first, second and third time and finally passed this 5th day of April 1993. RELEASE AND DISCHARGE WHEREAS the Agreement dated April 18, 1983, Notice of which was registered August 16, 1983, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT181623, between, RUNNYMEDE DEVELOPMENT CORPORATION LIMITED hereinafter referred to as the "Company" THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and developmem of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-71, inclusive, Blocks 72-85, inclusive, Rambleherry Avenue, Falconcrest Drive, Dixie Road, Meadowridge Crescent and Dunbarton Road on Plan 40M-1272, Town of Pickering, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Picketing, Ontario this. 5th day of April 1993. RELEASE AND DISCHARGE WHEREAS the Agreement dated April 18, 1983, Notice of which was registered November 16, 1984, in the Land Registry Office for the Land Titles Division of Durham {No. 40) as Instrument No. LT219845, between, RUNNYMEDE DEVELOPMENT CORPORATION LIMITED hereinafter referred to as the "Company" THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and developmem of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-124, inclusive, Blocks 125-138, inclusive, Glenanna Road, Rawlings Drive, Rowntree Crescent and Rathmore Crescent on Plan 40M-1333; and Lots I-I 15, inclusive, Blocks 116-119, inclusive, Silverthom Square, Deerhrook Drive and Honeywood Crescent on Plan 40M-1400; and Blocks 1-5, inclusive on Plan 40M-1591 all in the Town of Picketing, Regional Municipality of Durham.
