Being a by-law to prohibit the
littering of private or Town property.
WHEREAS, pursuant to the provisions of section 210.82 of the Municipal Act,
R.S.O. 1990, chapter M.45, the Council of The Corporation of the Town of
Picketing, being the council of a local municipality, pay pass by-laws for
prohibiting the throwing, placing, or depositing of refuse or debris on
private property or on property of the municipality without authority from the
owner or occupant of such property; and
WHEREAS, pursuant to the provisions of section 320 of the Act, the Council of
the Corporation of the Town of Pickering, being the council of a municipality,
may pass by-law for providing that any person who contravenes a by-law of the
Council passed under the authority of the Act is guilty of an offence;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY
ENACTS AS FOLLOWS:
1. In this by-law,
(a) "owner or occupant of such property", when referring to Town
property, means the Council of the Town or an employee of the Town'
(b) "private property" means those buildings, structures, lands and
premises within the Town of Pickering that are not Town property;
(c) "Town" means The Corporation of the Town of Pickering;
(d), "Town property" includes,
(i) buildings and structures within the Town of Pickering of
which the Town is the owner, lessee or licensee,
(ii) lands and premises within the Town of Pickering of which the
Town is the registered owner, lessee or licensee, and
(iii) lands and premises within the Town of Pickering the soil and
freehold of which are vested in the Town or the Council of
the Town by atatute or otherwise, and
without limiting the generality of the foregoing, includes those
roads and road allowances under the jurisdiction of the Town, whether
open or closed.
2. NO person shall throw, place or deposit refuse or debris on private
property without authority from the owner or occupant of such property.
3. NO person shall throw, place or deposit refuse or debris on Town property
without authority from the owner or occupant of such property.
4. Every person who contravenes any provision of this by-law is guilty of an
offence.
5. By-laws 3818/70 and 579/77 are hereby repealed.
By-law read a first, second and third time and finally passed this 15th day of
February, 1993.
