BY-LAW NO. 5 415/9 8
Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to
implement the Official Plan of the Town of Picketing District Planning Area,
Region of Durham in Part of Lot 20, Concession 1, in the Town of Picketing.

WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to
recognize the existing seniors retirement and nursing home facility on the subject lands, and
allow the establishment of a new building on those subject lands for the same purpose;
AND WHEREAS an amendment to By-law 3036, as amended, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:

Thc provisions of this By-law shall apply to those lands in Part of Lot 20, Concession 1,
Town of Picketing, designated "R(RH-NH)" on Schedule I attached hereto.

GENERAL PROVISIONS
No building, land or part thereof shall hereafter be used, occupied, erected, moved, or
structurally altered except in conformity with the provisions of this By-law.
4. DEFINITIONS
In this By-law,

"Dwelling Unit" shall mean one or more habitable rooms occupied or capable of
being occupied as a single, independent, and separate housingkeeping unit
containing a separate kitchen and sanitary facilities;
"Lot" shall mean an area of land fronting on a street which is used or intended to
be used as the site of a building, or group of buildings, as the case may be,
together with any accessory buildings or structures, or a public park or open space
area, regardless of whether or not such lot constitutes the whole of a lot or block
on a registered plan of subdivision;
"Nursing Home"' shall mean a building or part of a building where people are
lodged, fed, cared and provided for, and may be aided in any or all daily activities,
and may include the provision of nursing services, medical care or treatment, and
ancillary administrative offices, which is operated by a private, public, religious,
cultural or charitable organization, and which is duly licensed pursuant to the laws
of the Province of Ontario;

"Retirement Home" shall mean a residence providing accommodation primarily
for retired persons or couples where each private bedroom or living unit has a
separate entrance from a common hall, where common facilities for the
preparation and consumption of food are provided and common lounges,
recreation rooms, medical care facilities and ancillary administrative offices may
also be provided;
"Storey" shall mean that portion of a building other than a basement, cellar, attic,
or below-grade parking structure, included between the surface of any floor and
the surface of the floor, roof deck or ridge next above it;
"Yard" shall mean an area of land which is appurtenant to and located on the same
lot as a building or structure and is open, uncovered, and unoccupied above
ground except for such accessory buildings, structures, or other uses as are
specifically permitted thereon;

PROVISIONS
(1) (a) Uses Permitted ("R(RH-NH)" Zone)
No person shall within the lands designated "R(RH-NH)" on Schedule I
attached hereto, use any lot or erect, alter, or use any building or structure for
any purpose except the following:
(i) nursing home
(ii) retirement home
(b) Zone Requirements ("R(RH-NH)" Zone)
No person shall within the lands designated "R(RH-NH)" on Schedule I
attached hereto, use any lot or erect, alter, or use any building except in
accordance with the following provisions:
(i)
YARD SETBACKS (minimum):
As illustrated on Schedule I
attached hereto;
(ii)
BUILDING HEIGHT (maximum): As illustrated on Schedule I
attached hereto;
(iii) PARKING REQUIREMENTS:
A
There shall be provided and maintained on the lands designated
"R(RH-NH)" on Schedule I attached hereto a minimum of 164
parking spaces, which may be provided above and/or below
grade;
B
Sections 5.21.2 b) and 5.21.2 e) of By-law 3036, as amended,
shall not apply to the lands designated "R(RH-NH)" on
Schedule I attached hereto;
C
Notwithstanding Section 5.21.2 g) of By-law 3036, as
amended, all parking areas shall be surfaced with brick, asphalt
or concrete, or any combination thereof;
(iv) SPECIAL REGULATIONS:
A
No more than 430 total living units provided within a nursing
home and/or retirement home use are permitted on the lands
designated "R(RH-NH)" on Schedule I attached hereto;
B
For the purposes of this By-law, "Living Unit" shall mean one
or more habitable rooms occupied or capable of being occupied
as a single, independent, and separate housekeeping unit, and
which may include a separate kitchenette and/or sanitary
facilities, but is not a dwelling unit as defined herein.
6. BY-LAW
By-law 3036, as amended, is hereby further amended only to the extent necessary to give
effect to the provisions of this By-law as it applies to the area set out in Schedule I
attached hereto. Definitions and subject matters not specifically dealt with in this By-law
shall be governed by relevant provisions of By-law 3036, as amended.
7. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.
BY-LAW read a first, second, and third time and finally passed this
December, 1998.
