BY-LAW NO, 4525/94
Being a by-law to authorize the disposition of Part Lots 1
and 2, Plan 350, Pickering (Part 4, Plan 40R-15425) and
Part Lot 18, Plan 350, Pickering (Part 6, Plan 40R-
15425), not required for municipal purposes.
WHEREAS, pursuant to the provisions of section 191(1) of the Municipal Act, R.S.O. 1990, chapter
M.45, the Council of The Corporation of the Town of Picketing may pass by-laws for disposing of land
not required for the purposes of the Corporation; and
WHEREAS the Corporation no longer requires part of Lots 1 and 2, Plan 350, Picketing (Part 4, Plan
40R-15425) and part of Lot 18, Plan 350, Picketing (Pan 6. Plan 40R-15425), presently owned by it;
WHEREAS Her Majesty the Queen in Right of the Province of Ontario requires those lands for the
widening of Highway 401;
NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. The Corporation of the Town of Picketing shall sell to Her Majesty the Queen in Right of the
Province of Ontario, that pan of Lots 1 and 2, Plan 350, Picketing, designated as Part 4, Plan
40R-15425, and that part of Lot 18, Plan 350, Picketing, designated as Part 6, Plan 40R-15425,
subject to the following conditions:
(a) the sale price shall be $184,000;
(b) tter Majesty the Queen in Right of the Province of Ontario shall pay any Goods and
Services Tax otherwise payable by the Town in respect of the sale of the land;
(c) Her Majesty the Queen in Right of the Province of Ontario shall compensate the Town
for the cost of moving the Rougemount Public Library electric sign in the amount of
$9,000 and for loss of landscaping in the amount of $6,500; and
(d) Her Majesty the Queen in Right of the Province of Ontario shall agree to connect the
Rougemount Public Library to the regional municipal sanilary sewer, at no cost to the
Town, should the taking of the lands or the reconstruction of Highway 401 interfere with
the operation of the septic system presently serving the Rougemount Public Library.
2. The Mayor, the Town Clerk and the Town Solicitor are hereby authorized and directed to
execute all documentation required to effect the sale of the lands referred to in section 1 in
accordance with this By-law.
