BY-LAW NUMBER 4434/94
Being a By-law to amend By-law 2351/87, as amended, which amends Restricted
Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the
Town of Picketing District Planning Area, Region of Durham, in Part of Lots 17
and 18, Concession 1, in the Town of Pickering.

WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to add
retail warehouse-type B as a permitted use on the lands designated "M1-7/SPC-3" on Schedule I
to By-law 2351/87; and
WHEREAS an amendment to By-law 2351/87 is therefore necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. Section 4 of By-law 2351/87 (Definitions) is hereby amended by adding the following after
subsection (l 4):
(15) "Retail Warehouse-Type B" shall mean a warehouse of at least 1,400
square metres, having a floor-to-ceiling height of at least 5 metres, and in
which over 10% but less than 90% of the gross floor area is used for retail
sales, but does not include a supermarket or department store.
2. Subsection 5(1)(a) of By-law 2351/87 (Uses Permitted) is hereby amended by adding the
following after item (viii):
(ix) retail warehouse-type B
3. Subsection 5(1)(b)(iv) C of By-law 2351/87 (Parking Requirements) is hereby revoked and
the following is substituted for it:
C For a home and design centre and a retail warehouse-type B, there shall be
provided and maintained on the lands designated "MI-7/SPC-3" on Schedule 1
attached hereto, a minimum of 4.0 parking spaces per 100 square metres gross
leasable floor area;
