Being a by-law to stop up and close as public highway all
or parts of Blocks 48 to 54, and part of Valleyview Drive,
Plan 40M-1507, Picketing, and all of Blocks 48 and 49,
Plan 40M-1508, Pickering, and to authorize their sale to
abutting owners where not required for other municipal
purposes
WHEREAS, on June 20, 1988, pursuant to section 298(1)(a) of the Municipal Act, R.S.O. 1980, chapter
302, the Council of The Corporation of the Town of Pickering enacted By-laws 2809/88 and 2810/88,
dedicating Blocks 48, 49, 50, 51, 52, 53, 54 and 55, Plan 40M-1507, Pickering, and Blocks 47, 48, 49
and 50, Plan 40M-1508, Pickering, as public highway (to become part of Valleyview Drive); and
WHEREAS Valleyview Drive, Plan 40M-1507, Pickering, is a highway shown on a plan of subdivision
and is therefore deemed to be a public highway pursuant to section 57 of the Surveys Act, R.S.O. 1990,
chapter S.30; and
WHEREAS, on April 11, 1990, pursuant to section 263 of the Municipal Act, R.S.O. 1990, chapter
M.45, the Council of the Town (having jurisdiction over that highway) enacted By-law 4409/94
assuming that highway for public use as public highway under the jurisdiction of The Corporation of the
Town of Picketing, as a result of which, pursuant to section 262 of that Act, the soil and freehold of the
lands comprising that highway is vested in The Corporation of the Town of Pickering; and
WHEREAS, pursuant to sections 191(1), 297(1)(c), 297(1)(d) and 315 of that Act, the Council of the
Town may pass by-laws to stop up a highway or part thereof and to authorize its sale or the sale of a part
thereof at a fixed price;
NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS
FOLLOWS:
1. The following portions of highway are hereby stopped up and closed to both vehicular and
pedestrian traffic:
(a) those parts of Block 48, Plan 40M-1507, Pickering, designated as Parts 16, 17, 18, 23, 32,
33 and 34, Plan 40R-14939;
(b) that part of Block 49, Plan 40M-1507, Picketing, designated as Part 31, Plan 40R-14939;
(c) those parts of Block 50, Plan 40M-1507, Picketing, designated as Parts 5 and 7, Plan
40R- 14939;
(d) all of Blocks 51, 52, 53 and 54, Plan 40M-1507, Pickering;
(e) that part of Block 55, Plan 40M-1507, Pickering, designated as Part 30, ?lan 40R-14939;
(f) those parts of Valleyview Drive, Plan 40M-1507, Pickering, designated as Parts 29 and
39, Plan 40R-14939; and
(g) all of Blocks 48 and 49, Plan 40M-1508, Pickering.
2. The Corporation of the Town of Pickering shall dispose of utility easements over any of the
lands described in section 1, above, that presently contain utility structures of any nature or sort,
to the appropriate utility authority, including but not necessarily limited to, The Regional
Municipality of Durham, Bell Canada, Consumers Gas, and Pickering Hydro, at a sale price of
$2.00 each.
3. (a) Those parts of Block 48, Plan 40M-1507, Picketing, designated as Parts 23, 32, 33 and
34, Plan 40R-14939; that part of Block 49, Plan 40M-1507, Picketing, designated as Part
31, Plan 40R-14939; Blocks 53 and 54, Plan 40M-1507, Picketing; that part of Block 55,
Plan 40M-1507, Picketing, designated as Part 30, Plan 40R-14939; and that part of
Valleyview Drive, Plan 40M-1507, Picketing, designated as Part 29, Plan 40R-14939,
shall be offered for sale to the abutting owner to the east at a sale price of $2.00, subject
to any utility easement or easements previously granted or granted pursuant to section 2,
above.
(b) That part of Block 50, Plan 40M-1507, Pickering, designated as Part 5, Plan 40R-14939,
shall be offered for sale to the abutting owner to the south-west at a sale price of $2.00,
subject to any utility easement or easements previously granted or granted pursuant to
section 2, above.
(c) Block 51, Plan 40M-1507, Picketing, shall be offered for sale to the abutting owner to the
east at a sale price of $2.00, subject to any utility easement or easements previously
granted or granted pursuant to section 2, above.
(d) Block 52, Plan 40M-1507, Picketing, and that part of Valleyview Drive, Plan 40M-1507,
Picketing, designated as Part 39, Plan 40R-14939, shall be offered for sale to the abutting
owner to the east at a sale price of $2.00, subject to any utility easement or easements
previously granted or granted pursuant to section 2, above.
(e) Block 48, Plan 40M-1508, Picketing, shall be offered for sale to the abutting owner to the
east at a sale price of $2.00, subject to any utility easement or easements previously
granted or granted pursuant to section 2, above.
(f) Block 49, Plan 40M-1508, Pickering, shall be offered for sale to the abutting owner to the
east at a sale price of $2.00, subject to any utility easement or easements previously
granted or granted pursuant to section 2, above.
4. (1) The offers referred to in section 3, above, shall be made by the Town on or before April
29, 1994.
(2) The period within which an abutting owner may exercise the right to purchase the lands
offered in any offer under section 3, above, shall commence at 9:00 am on April 18, 1994
and end at 4:00 pm on May 31, 1994, both Eastern Daylight Saving Time.
5. The Mayor and Clerk are hereby authorized to execute any documents approved by the Town
Solicitor and required to effect the dispositions, offers and transfers provided for in this By-law.
