BY-LAW NUMBER 4 6 5 7/9 5
Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to
implement the Official Plan of the Town of Picketing District Planning Area,
Region of Durham in Part of Lots 1-6, Plan 329, in the Town of Picketing.

WHEREAS the Council of the Corporation of the Town of Picketing deems it desirable to
permit the development of 59 residential lots having minimum frontages of 13.5 metres, 11.0
metres and 7.5 metres on the lands, being Parts of Lots 1- 6, Plan 329, Town of Pickering;
AND WHEREAS an amendment to By-law 3036, as amended, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
Schedule I attached hereto with notations and references shown thereon is hereby
declared to be part of this By-law.
The provisions of this By-law shall apply to those lands in Part of Lots 1-6, Plan 329,
Picketing, designated "S2", "S4", "SD-A", "S-SD-A-2", "NP" and "OS-HL-I" on
Schedule I attached hereto.
3. GENERAL PROVISIONS
No building, land or part thereof shall hereafter be used, occupied, erected, moved or
structurally altered except in conformity with the provisions of this By-law.
In this By-law,
(1) (a) ~ shall mean a building or part of a building containing one or
more dwelling units, but does not include a mobile home or trailer;
(b) ~ shall mean one or more habitable rooms occupied or capable
of being occupied as a single, independent and separate housekeeping unit
containing a separate kitchen and sanitary facilities;
(c) "Dwelling, Single or Single Dwelling" shall mean a single dwelling
containing one dwelling unit and uses accessory hereto;
(d) "Dwelling. Detached or Detached Dwelling" shall mean a single dwelling
which is freestanding, separate and detached from other main buildings or
structures;

(e) "Dwelling. Semi-Detached or Semi-Detached Dwelling" shall mean one of a
pair of single dwellings, such dwellings being attached together horizontally
in whole or in part above grade, below grade, or both above and below grade.
(2) (a) "Floor Area-Residential" shall mean the area of the floor surface contained
within the outside walls of a storey or part of a storey;
(b) "Gross Floor Area-Residential" shall mean the aggregate of the floor areas of
all storeys of a building or structure, or part thereof as the case may be, other
than a private garage, an attic or a cellar.
(3) (a) "Lot" shall mean an area of land fronting on a street which is used or
intended to be used as the site of a building, or group of buildings, as the case
may be, together with any accessory buildings or structures, or a public park
or open space area, regardless of whether or not such lot constitutes the
whole of a lot or block on a registered plan of subdivision;
(b) 2L.Ql_CO_v_camge" shall mean the percentage of lot area covered by all buildings
on the lot;
(c) 2Lg_LEmalag~ shall mean the width of a lot between the side lot lines
measured along a parallel to and 7.5 metres distant from the front lot line.
(4) "P_zi.y. al.c._Q, arag~shall mean an enclosed or partially enclosed structure for the
storage of one or more vehicles, in which structure no business or service is
conducted for profit or otherwise.
(5) "' "shall mean a municipal public park.
(6) (a) /LYar~ shall mean an area of land which is appurtenant to and located on the
same lot as a building or structure and is open, uncovered and unoccupied
above ground except for such accessory buildings, structures, or other uses as
are specifically permitted thereon;
(b) "Front Yard" shall mean a yard extending across the full width of a lot
between the front lot line of the lot and the nearest wall of the nearest main
building or structure on the lot;
(c) ~ shall mean the shortest horizontal dimension of a front
yard of a lot between the front lot and the nearest wall of the nearest main
building or structure on the lot;
(d) "Rear Yard" shall mean a yard extending across the full width of a lot
between the rear lot line of the lot, or where there is no rear lot line, the
junction point of the side lot lines, and the nearest wall of the nearest main
building or structure on the lot;
(e) 21~2~1111~11~ shall mean the shortest horizontal dimension of a rear
yard of a lot between the rear lot line of the lot, or where there is no rear lot
line, the junction point of the side lot lines;
(f) "Side Yard" shall mean a yard of a lot extending from the front yard to the
rear yard and from the side lot line to the nearest wall of the nearest main
building or structure on the lot;

(g) "Side Yard Width" shall mean the shortest horizontal dimension of a side
yard of a lot between the side lot line and the nearest wall of the nearest main
building or structure on the lot;
(h) ~ shall mean a side yard immediately adjoining a street
or abutting on a reserve on the opposite side of which is a street;
(i) Flanka_ee Side Yard Width" shall mean the shortest horizontal dimension of a
flankage side yard of a lot between the lot line adjoining a street or abutting
on a reserve on the opposite side of which is a street and the nearest wall of
the nearest main building or structure on the lot; and
(j) "Interior Side Yard" shall mean a side yard other than a flankage side yard.
5. PROVISIONS
(1) (a) Uses Permitted ("S2")
No person shall within the lands designated "S2" on Schedule I attached
hereto use any lot or erect, alter or use any building or structure for any
purpose except the following:
(i) detached dwelling residential use
(b) ~ CS2")
No person shall within the lands designated "S2" on Schedule I attached
hereto use any lot or erect, alter or use any building or structure for any
purpose except in accordance with the following provisions:
(i) LOT AREA (minimum) 400 square metres
(ii) LOT FRONTAGE (minimum) 13.5 metres
(iii) FRONT YARD DEPTH (minimum) 4.5 metres
(iv) INTERIOR SIDE YARD XVIDTH:
A minimum 1.2 metres each side; or
B minimum 1.8 metres one side and no minimum other side
(v) FLANKAGE SIDE YARD WIDTH (minimum) 2.7 metres
(vi) REAR YARD DEPTH (minimum) 7.5 metres
(vii) LOT COVERAGE (maximum) 38 percent
(viii)BUILDING HEIGHT (maximum) 12 metres
(ix) DWELLING UNIT REQUIREMENTS: maximum one dwelling
unit per lot and minimum gross floor area-residential of 100 square
metres.
(x) PARKING REQUIREMENTS (minimum): one private garage per
lot

(xi) SPECIAL REGULATIONS:
A the vehicular entrance to garages shall be located not less than 6
metres from the front lot line and not less than 6 metres from any
side lot line immediately adjoining a street or abutting on a reserve
on the opposite side of which is a street.
B notwithstanding clause A above, where the vehicular entrance of a
private garage is perpendicular to the front lot line, the nearest wall
of that private garage shall be located a minimum of 4.5 metres
from the front lot line, and vehicular entrance shall be located not
less than 6.0 metres from the side lot line immediately adjoining a
street.
C all accessory buildings which are not part of the main dwelling
shall be erected in the rear yard and shall not be less than 1.0 metre
from any lot line, save and except that a private detached garage
may be located in any yard not less than 0,6 metres from any side
lot line and 0.6 metres from any rear lot line.
D no part of any attached garage, whether or not such garage has a
second storey, shall extend more than 1.2 metres beyond the wall
containing the main entrance to the dwelling unit.
E on lands zoned "S2", the horizontal distance between buildings on
adjacent lots shall not be less than 1.2 metres.
F notwithstanding the provisions of Section 5.(1)(viii) above, the
maximum building height of any detached garage shall be 3.6
metres.
G covered porches, stairs and platforms not exceeding 1.0 metre in
height above grade may project a maximum of 1.5 metres into a
required front yard or flankage yard.
(2) (a) Uses Permitted ("84")
No person shall within the lands designated "S4" on Schedule I attached
hereto use any lot or erect, alter or use any building or structure for any
purpose except the following:
(i) detached dwelling residential use
(b) ~ ("S4")
No person shall within the lands designated "84" on Schedule I attached
hereto use any lot or erect, alter or use any building or structure for any
purpose except in accordance with the following provisions:
(i) LOT AREA (minimum) 300 square metres
(ii) LOT FRONTAGE (minimum) 11 metres
(iii) FRONT YARD DEPTH (minimum) 4.5 metres

(iv) INTERIOR SIDE YARD WIDTH:
A minimum 1.2 metres one side, 0.6 metres other side; or
B no minimum one side, provided on the other side;
(I) a minimum 1.2 metre interior side yard is provided to the
nearest wall of a private garage; and
(II) a minimum 1.8 metre interior side yard is provided to any
other wall of the main dwelling.
(v) FLANKAGE SIDE YARD WIDTH (minimum) 2.7 metres
(vi) REAR YARD DEPTH (minimum) 7.5 metres
(vii) LOT COVERAGE (maximum) 38 percent
(viii) BUILDING HEIGHT (maximum) 12 metres
(ix) DWELLING UNIT REQUIREMENTS: maximum one dwelling
unit per lot and minimum gross floor area-residential of 100 square
metres.
(x) PARK1NG REQUIREMENTS (minimum): one private garage per
lot
(xi) SPECIAL REGULATIONS:
A the vehicular entrance to detached garages shall be located not less
than 6 metres from the front lot line and not less than 6 metres
from any side lot line immediately adjoining a street or abutting on
a reserve on the opposite side of which is a street.
B notwithstanding clause A above, where the vehicular entrance of a
private garage is perpendicular to the front lot line, the nearest wall
of that private garage shall be located a minimum of 4.5 metres
from the front lot line, and vehicular entrance shall be located not
less than 6.0 metres from the side lot line immediately adjoining a
street.
C all accessory buildings which are not part of the main dwelling
shall be erected in the rear yard and shall not be less than 1.0 metre
from any lot line, save and except that a private detached garage
may be located in any yard not less than 0.6 metres from any side
lot line and 0.6 metres from any rear lot line.
D no part of any attached garage, whether or not such garage has a
second storey, shall extend more than 1.2 metres beyond the wall
containing the main entrance to the dwelling unit.
E notwithstanding the provisions of Section 5. (2)(viii) above, the
maximum building height of any detached garage shall be 3.6
metres.
F covered porches, stairs and platforms not exceeding 1.0 metre in
height above grade may project a maximum of 1.5 metres into a
required front yard or flankage yard.
G on lands zoned "S4", the horizontal distance between buildings on
adjacent lots shall not be less than 1.2 metres.

(3) (a) Uses Permitted ("SD-A" Zone)
No person shall within the lands designated "SD-A" on Schedule I attached
hereto use any lot or erect, alter or use any building or structure for any
purpose except in accordance with the following provisions:
(i) semi-detached residential uses

(i) LOT AREA (minimum) 225 square metres
(ii) LOT FRONTAGE (minimum) 7.5 metres
(iii) FRONT YARD DEPTH (minimum) 4.5 metres
(iv) INTERIOR SIDE YARD WIDTH (minimum):
A 1.2 metres; and
B on the side where dwellings on adjacent lots are attached, no
interior side yard is required, provided any wall other than the
common wall that is on the side of the lot upon which the
dwellings are attached, shall be set back from the lot line
separating such lots as follows:
(I) 1.2 metres measured perpendicularly to such side lot line
if no side yard is provided on the abutting lot; or
(II) 0.6 metres measured perpendicularly to such side lot line
ifa side yard is provided on the abutting lot.
(v) FLANKAGE SIDE YARD WIDTH (minimum) 2.7 metres
(vi) REAR YARD DEPTH (minimum):
A 7.5 metres
B 16.5 metres when the lot also includes an "OS-HL-I" zone
(vii) LOT COVERAGE (maximum) 45 percent
(viii) BUILDING HEIGHT (maximum) 12 metres
(ix) DWELLING UNIT REQUIREMENTS: maximum one dwelling
unit per lot and minimum gross floor area-residential of 100 square
metres.
(x) PARKING REQUIREMENTS (minimum): one private garage per
lot (attached or detached)
(xi) SPECIAL REGULATIONS:
A the vehicular entrance to a garage shall be located not less than 6
metres from the front lot line and not less than 6 metres from any
side lot line immediately adjoining a street or abutting on a reserve
on the opposite side of which is a street.

B notwithstanding Section 5.18 (a) of By-law 3036, a detached
garage shall be located not less than 0.6 metres fi.om both the side
lot line and rear lot line, except where a mutual garage is erected
on the common lot line, no setback is required from such lot line.
C no part of any attached garage, whether or not such garage has a
second storey, shall extend more than 1.2 metres beyond the wall
containing the main entrance to the dwelling.
D notwithstanding the provisions of Section 5. (3)(viii) above, the
maximum building height of any detached garage shall be 3.6
metres.
E covered porches, stairs and platforms not exceeding 1.0 metre in
height above grade may project a maximum of 1.5 metres imo a
required from yard or flankage yard.
F notwithstanding the definition of "Dwelling, Semi-Detached or
Semi-Detached Dwelling" in Section 4 (1)(e) of this by-law, Semi-
Detached Dwellings erected in an "SD-A" zone shall be attached
above grade by a common wall which shall not be less than 3.0
metres in length and not less than 2.4 metres in height.
(4) (a) Uses Permitted CS-SD-A-2" Zone)
No person shall within the lands designated "S-SD-A-2" on Schedule I
attached hereto use any lot or erect, alter or use any building or structure for
any purpose except in accordance with the following provisions:
(i) single detached or semi-detached residential uses
(b) ~lp~a~lllkmllgll~("S-SD-A-2" Zone)
(i) LOT AREA (minimum):
A 225 square metres for semi-detached dwellings
B 300 square metres for detached dwellings
(ii) LOT FRONTAGE (minimum):
A 11 metres for detached dwellings
B 7.5 metres for semi-detached dwellings
(iii) FRONT YARD DEPTH (minimum) 4.5 metres
(iv) INTERIOR SIDE YARD WIDTH:
A Detached Dwellings:
(I) minimum 1.2 metres one side, 0.6 metres other side; or
(II) no minimum one side, provided on the other side;
(a) a minimum 1.2 metre interior side yard is provided to
the nearest wall of a private garage, and
(b) a minimum 1.8 metre interior side yard is provided to
any other wall of the main dwelling

B Semi-detached Dwellings:
(I) 1.2 metres; and
(II) on the side where dwellings on adjacent lots are attached, no
interior side yard is required, provided any wall other than
the common wall that is on the side of the lot upon which the
dwellings are attached, shall be set back from the lot line
separating such lots as follows:
(a) 1.2 metres measured perpendicularly to such side lot
line if no side yard is provided on the abutting lot; or
(b) 0.6 metres measured perpendicularly to such side lot
line ifa side yard is provided on the abutting lot.
(v) FLANKAGE SIDE YARD WIDTH (minimum): 2.7 metres
(vi) REAR YARD DEPTH (minimum): 7.5 metres
(vii) LOT COVERAGE (maximum): 38 percent for detached dwellings

(viii) BUILDING HEIGHT (maximum): 12 metres
(ix) DWELLING LrNIT REQUIREMENTS: maximum one
dwelling unit per lot and minimum gross floor area-residential of 100
square metres.
(x) PARKING REQUIREMENTS (minimum): one private garage per
lot
(xi) SPECIAL REGULATIONS:

metres from the front lot line and not less than 6 metres from any
side lot line immediately adjoining a street or abutting on a reserve
on the opposite side of which is a street.
B notwithstanding Section 5.18 (a) of this By-law, a detached garage
shall be located not less than 0.6 metres from both the side lot line
and rear lot line, except where a mutual garage is erected on the
common lot line, no setback is required from such lot line.
C no part of any attached garage, whether or not such garage has a
second storey, shall extend more than 1.2 metres beyond the wall
containing the main entrance to the dwelling unit.
D notwithstanding the provisions of Section 5. (4)(viii) above, the
maximum building height of any detached garage shall be 3.6
metres.
E covered porches, stairs and platforms not exceeding 1.0 metre in
height above grade may project a maximum of 1.5 metres into a
required front yard or flankage yard.
F notwithstanding the definition of "Dwelling, Semi-Detached or
Semi-Detached Dwelling" in Section 4 (1)(e) of this by-law, Semi-
Detached Dwellings erected in an "S-SD-A-2" zone shall be
attached above grade by a common wall which shall not be less
than 3.0 metres in length and not less than 2.4 metres in height.

(5) (a) Uses Permitted ("OS-HL-I" Zone)
No person shall within the lands designated "OS-HL-1" on Schedule I attached
hereto use any lot or erect, alter or use any building or structure for any purpose
except the following:
(i) conservation of the natural environment, soil, and wildlife;
(ii) resource management.
(b) ~ ("OS-HL-1" Zone)
No buildings or structures shall be erected, nor any existing buildings or
structures be enlarged, modified or changed, nor shall fill be placed or removed
except for purposes of flood and erosion control or resource management.
(6) (a) Uses Permitted ("NP" Zone)
No person shall within the lands designated "NP" on Schedule I attached hereto
use any lot or erect, alter or use any building or structure for any purpose except
the following:
(i) neighbourhood park
By-law 4584/95, as it affects those lands in Part of Lots 1-6, Plan 329, in the Town of
Picketing, designated "S2", "S4", "SD-A", "S-SD-A-2", "NP" and "OS-HL-1" on
Schedule I attached hereto, is hereby repealed.
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.
