BY-LAW NUMBER 4 6 5 5~95
Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended by
By-laws 1521/82 and 2495/87, to implement the Official Plan of the Town of
Pickering District Planning Area, Region of Durham, in Block 22, Plan 40M-1365,
in the Town of Pickering.

WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 1521/82,
amending By-law .3036, to permit the development of detached dwellings, semi-detached
dwellings, a neighbourhood park and a commercial on the subject lands, being Block 22 Plan
40M-1365, in the Town of Picketing;
AND WHEREAS the Council of the Corporation of the Town of Picketing passed By-law
2495/87, amending By-law 1521/82, to permit professional offices within the commercial zone
of the subject lands, being Block 22, Plan 40M-1365, in the Town of Picketing;
AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it
desirable to further amend By-law 3036, as amended by By-laws 1521/82 and 2495/87 to permit
additional commercial and personal services uses, on the subject lands, being Block 22, Plan
40M- 1365, Town of Picketing;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
(1) Section 4, DEFINITIONS, of By-law 1521/82 as amended by By-law 2495/87 is
hereby further amended by adding thereto the following clauses:
(a) ~ shall mean a building or part of a building in which the
management or direction of a business, a public or private agency, a brokerage
or a labour or fraternal organization is carried on and which may include a
telegraph office, a data processing establishment, a newspaper publishing office,
the premises of a real estate or insurance agent, or a radio or television
broadcasting station and related studios or theatres, but shall not include a retail
store;
(d) "Financial Insti~tion" shall mean a building or part of a building in which
money is deposited, kept, lent or exchanged;
(j) ~ shall mean an area of not more than 150 square metres
gross leasable floor area containing facilities where pharmaceutical proscriptions
are compounded and dispensed for the public by a pharmacist licensed pursuant
to the Health Disciplines Act, R.S.O. 1980, Chapter 196 as amended from time
to time, or any successor thereto, and where medicine, medical supplies and
associated memhandise is stored, displayed and offered for retail sale to the
public;
(p) ~ shall mean a building or part of a building in which goods, wares,
merchandise, substances, articles or things are stored, kept and offered for retail
sale to the public;

(2) Section 4, DEFINITIONS, of By-law 1521/82 as amended by By-law 2495/87 is
hereby further amended by re-alphabetizing (a) to (1) inclusive to accommodate the
amendment in Section 1. of this By-law.
(3) Section 5. (3) (a) of By-law 1521/82, as amended by By-law 2495/87, is hereby further
amended by adding thereto the following items:
(i) business office
(iii) financial institution
(v) medical dispensary
(ix) retail store
(4) Section 5. (3) (a) of By-law 1521/82, as amended by By-law 2495/87, is hereby further
amended by renumbering (i) to (v) inclusive to accommodate the amendment in Section
1 .(3) of this By-law.
(5) Section 5. (3) (a) (v) of Bylaw 1521/82 as amended by By-law 2495/87, is hereby
further amended by deleting the words "subject to the provisions of Section 5. (3) (b)
(x)".
(6) Section 5. (3) (b) (x) of By-law 1521/82 as amended by By-law 2495/87, is hereby
further amended by adding thereto the following:
B the aggregate of the gross floor area of any: business offices; financial institutions;
or any retail stores shall not exceed 200 square metres respectively.
(7) Section 5. (3) (b) (x) of By-law 1521/82, as amended by By-law 2495/87, is hereby
further amended by alphabetizing the existing Section to accommodate the amendment
in Section 1 .(6) of this By-law.
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.
