HomeMy WebLinkAboutBy-law 4571/95 THE CORPORATION OF TIlE TOWN OF PICKERIN~ DY-LAW NO, 4571/95 Being a by-law to authorize the execution of a Release q£ a Subdivision Agreement and amendments thereto between the Corporation of the Town of Pickering and Rulor Developments Limited respecting that part of Lot 9, Plan 40M-1604, Pickering, designated as Part 5, Plan 40R-15426. WHEREAS, pursuant to the predecessor of Planning Act, R.S.O. 1990, chapter P.I 3, section 51, The Corporation of the Town of Pickering and Rulor Developments Limited entered into a Subdivision Agreement dated April 3, 1989, registered as Instrument Number LT454295, which was subsequently amended September 18, 1989 and registered as Instrument Number LT464222 and further amended December 21, 1992, and registered as Instrument Number LT640225; and WHEREAS, certain terms and conditions of those agreements insofar as they relate to a portion of the lands are no longer necessary and should therefore be removed from title. NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: I. The Mayor and Clerk are hereby authorized to execute a Release, in the form attached hereto as Schedule A, of a Subdivision Agreement dated April 3, 1989, registered as Instrument Number LT454295, between The Corporation of the Town of Picketing and Rulor Development Limited, as amended by an Agreement dated September 18, 1989, registered as Instrument Number LT464222 and further amended on December 21, 1992, registered as Instrument Number LT640225 insofar as they relate to that part of Lot 9, Plan 40M-1604, Pickering, designated as Par~ 5, Plan 40R-15426. BY-LAW read a first, second and third time and finally passed this 20th day of February, 1995. 1 L'?., L DJ--,~'f. RELEASE In consideration of the sum of Two Dollars ($2.00) paid to it, receipt of which is hereby by it acknowledged; and WHEREAS the Subdivision Agreement dated April 3, 1989, notice of which was registered June 20, 1989 in the Land Registry Office for the Land Titles Division (No. 40) as Instrument No. LT454295, between, THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town" and RULOR DEVELOPMENTS LIMITED hereinafter referred to as the "Company" as amended by Agreement dated September 18, 1989, notice of which was registered August 18, 1989 as Instrument No. LT464222 and Agreement dated December 21, 1992, notice of which was registered May 25, 1993, as Instrument No. LT640225 provided for the subdivision and development of the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its heirs, executors, administrators, successors and assigns, of and from all claims, demands, damages, actions or causes of action which may have arisen, are arising, or may arise as a result of or in any way related to those agreements, insofar as they relate to that part of Lot 9, Plan 40M-1604, Pickering, designated as Part 5, Plan 40R-15426. IN WITNESS WHEREOF The Corporation of the Town of Pickering has hereunto affixed its corporate seal attested by its properly authorized officers this 20th day of February, 1995.
