HomeMy WebLinkAboutInformation Report 17-11Information Report ani Report Number: 17-11 For Public Information Meeting of PICKERING Date: September 6, 2011 In Accordance with the Public Meeting Requirements of the Planning Act, R.S.O. 1990, chapter PA 3 Subject: Zoning Amendment Application A 7/11 Loblaw Properties Limited 1792 Liverpool Road (Part Lot 23, Concession 1 South) City of Pickering 1.0 Property Location and Description • the subject property is generally located behind the southwest corner of. Kingston Road and Liverpool Road with an area of approximately 4.7 hectares (see Location Map - Attachment #1) • the property is occupied by a 14,964 square metre commercial complex consisting of a variety of retail stores, with the major anchor being Loblaw's Superstore • Loblaw's is permitted to operate a seasonal garden centre with a maximum area of 1,055 square metres in the western portion of the parking lot, from April 1st to August 31 st of every calendar year, through a Committee of Adjustment decision in 2005 • the surrounding land uses include: north - a commercial plaza and Kingston Road west - vacant land containing an open channel of Pine Creek south - vacant land owned by the Provincial government east - Liverpool Road, a commercial plaza and restaurant uses 2.0 Applicant's Proposal the applicant has requested to amend the zoning by-law to permit a seasonal garden centre use of 1,583 square metres located in the centre of the parking lot (see Applicant's Submitted Plan — Attachment #2) the pro Vosed seasonal garden centre would be in operation annually between April 15 and August 31St, and would occupy 84 parking spaces no exterior changes to the existing buildings are proposed 17 Information Report No. 17-11 3.0 Official Plan and Zoning 3.1 Pickering Official Plan Page 2 • the City of Pickering Official Plan designates the subject lands as "Mixed Use Areas — Mixed Corridors" within the Town Centre Neighbourhood • permissible uses include, among others, retailing of goods and services, residential uses and community and cultural uses as well as limited office commercial uses • these areas. are intended to have the widest variety of uses and highest levels of activities in the City • Schedule II — "Transportation System" designates Kingston Road and Liverpool Road as "Type B — Arterial Roads" 3.2 Pickering Downtown Core and Kingston Road Development Guidelines • the subject property is subject to the Pickering Downtown Core and Kingston Road Corridor Development Guidelines • objectives include: • creating a regional landmark and destination area • establishing the highest intensity of cultural, residential and economic activity, and the greatest density and diversity of land use mix • encouraging pedestrian activity along Kingston Road 3.3 Zoning By-law 3036 as amended by 1608/83 • the subject property is currently zoned "C7" — General Commercial • the existing zoning permits 1,055 square metres of outdoor storage associated with a garden centre use from April Vt to June 30th of every calendar year to be located in the western portion of the parking lot • an amendment to the zoning by-law is required to permit a seasonal garden centre of 1,583 square metres to be located in the centre of the parking lot, and to permit a reduction in the parking supply during the operation of the seasonal garden centre 4.0 Results of Circulation 4.1 Resident Comments • none received to date 4.2 Agency Comments • none received to date 4.3 Department Comments 0 none received to date Information Report No. 17-11 Page 3 0 4.4 Staff Comments in reviewing the application to date, the following matters have been identified. by staff for further review and consideration: • ensuring that the proposed application complies with the Pickering Downtown Core Development Guidelines and the Kingston Road Corridor Urban Design Development Guidelines • determining the appropriateness of the proposed seasonal garden centre size and location, and temporary parking supply reduction • reviewing the application in terms of its level of sustainable development components • site plan matters, including, but not limited to, parking, vehicle and pedestrian movements, and landscaped areas and features 5.0 Procedural Information • written comments regarding this proposal should be directed to the Planning & Development Department • oral comments may be made at the Public Information Meeting • all comments received will be noted and used as input in a Planning Report prepared by the Planning & Development Department for a subsequent meeting of Council or a Committee of Council • any member of the public who wish to reserve the option to appeal Council's decision must provide comments to the City before Council adopts any by-law for this proposal • any member of the public who wish to be notified of Council's decision regarding this proposal must request such in writing to the City Clerk • if a person or public body that files an appeal of a decision of the.City of Pickering in respect of the proposed zoning by-law amendment does not make oral submission at the public meeting, or make written submissions to the City of Pickering before the proposed zoning by-law amendment is approved or refused, the Ontario Municipal Board may dismiss the appeal 6.0 Other Information 6.1 Appendix No. I • list of neighbourhood residents, community associations, agencies and City Departments that have commented on the applications at the time of writing report Information Report No. 17-11 6.2 Information Received Page 4 • in addition to the full scale copies of the Applicant's Submitted Plan, the following documents are available for viewing at the offices of the City of Pickering Planning & Development Department: • Planning Justification Letter • Sustainable Development Report • Parking Study 6.3 Company Principal • the owner of the property is Loblaw Properties Limited • the applicant is Zelinka Priamo Ltd.
