HomeMy WebLinkAboutBy-law 4995/97 THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 4995/97 Being a by-law to stop-up and close as public highway those parts of Road Allowance between Lots 34 and 35, Concession 1, Pickering, being Parts 4-34, Plan 40R- 16978, for the purposes of sale to the abutting owners. WHEREAS, pursuant to section 297(1)(a) of the Municipal Act, R.S.O. 1990, chapter M.45, the Council of The Corporation of the Town of Pickering enacted a by-law dedicating as public highway, those parts of Road Allowance between Lots 34 and 35, Concession 1, Pickering, being Parts 4-34, Plan 40R-16978 (Pine Grove Avenue); and WHEREAS, pursuant to sections 191(1), 297 (d) and 315 of that Act, the Council of the Town may pass by-laws to stop-up a highway or part thereof for the purposes of sale to the abutting owners; NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: 1. The following portions of highway are hereby stopped up and closed to both vehicular and pedestrian traffic: (a) Those parts of Road Allowance between Lots 34 and 35, Concession 1, Pickering, designated as Parts 4 to 34, Plan 40R-16978. 2. The Corporation of the Town of Pickering shall dispose of utility easements over any of the lands described in section 1, above, that presently contain utility structures of any nature or sort, to the appropriate utility authority, including but not necessarily limited to, The Regional Municipality of Durham, Bell Canada, Consumers Gas, and Pickering Hydro, at a sale price of $2.00 each. 3. Those parts of the Road Allowance between Lots 34 and 35, Concession 1, Pickering, designated as Parts 4 to 34, inclusive, Plan 40R-16978, shall be offered for sale to the abutting owners at a nominal price, plus disbursements and legal costs and subject to any utility easements granted pursuant to section 2 above. 4. The Mayor and Clerk are hereby authorized to execute any documents approved by the Town Solicitor required to effect the dispositions and transfers provided for in this By-law. BY-LAW read a first, second and third time and finally passed this 5th day of May, 1997.
