HomeMy WebLinkAboutBy-law 5338/98THE CORPORATION OF THE TOWN OF PICKERING BY-LAWN-UMBER 5338/98 Being a By-law to amend By-law 4963/97, which amends Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham on Blocks 16 to 19, Plan 40M- 1887, in the Town of Picketing. (A 8/98) WHEREAS the Council of the Corporation of the Town of Picketing approved By-law 4963/97, amending Restricted Area (Zoning) By-law 3036, as amended, to permit a range of medium density dwelling types, a public walkway and open space uses on the lands being Part of Lot 19, Concession 2, (Lots 1 to 10, and Blocks 11 to 19, Plan 40M-1887)in the Town of Picketing; AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it desirable to amend By-law 4963/97, to permit the development of 9 townhouse dwelling units to replace the previously approved 16 quadruplex dwelling units on the lands being Blocks 16 to 19, Plan 40M-1887, in the Town of Pickering; AND WHEREAS an amendment to By-law 4963/97 is therefore necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. TEXT AMENDMENTS (1) (2) (3) Section 2. of By-law 4963/97 is hereby amended by deleting "MD-QI" and replacing it with "RMM- 1 (A)". Section 4.(2) of By-law 4963/97 is hereby amended by deleting section (f). Section 6. of By-law 4963/97 is hereby revoked and the following is substituted thereto: e PROVISIONS (1) Uses Permitted ("RMM-I(A)" Zone) No person shall within the lands designated "RMM-I(A)" on Schedule I attached hereto use any lot or erect, alter or use any building or structure for any purpose except the following residential uses: (a) multiple dwelling - horizontal (2) Zone Requirements ("RMM-1 (A)" Zone) No person shall within the lands designated "RMM-I(A)" on Schedule I attached hereto use any lot or erect, alter or use any building or structure for any purpose except in accordance with the multiple dwelling - horizontal provisions as set out in Section 5.(2) of this By-law. -2- SCHEDULE I AND II Schedule 'T' and "II" of By-law 4963/97 are hereby revoked and Schedule 'T' and "II" attached hereto and forming part of this By-law are substituted therefor. o EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
