BY-LAW NO. 5 3 3 0 / 9 8
Being a by-law to prohibit the littering of private or Town
property.
WHEREAS, pursuant to the provisions of Section 210.82 of the Municipal Act, R.S.O. 1990, chapter M.45, the
Council of The Corporation of the Town of Picketing, being the council of a local municipality, may pass by-
laws for prohibiting the throwing, placing, or depositing of refuse or debris on private property or on property of
the municipality without authority from the owner or occupant of such property; and
WHEREAS, pursuant to the provisions of Section 320 of the Act, the Council of The Corporation of the Town of
Picketing, being the council of a municipality, may pass by-laws for providing that any person who contravenes
a by-law of the Council passed under the authority of the Act is guilty of an offence;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY
ENACTS AS FOLLOWS:
1. In this by-law,
(a)
"private property" means those buildings, structures, lands and premises within the Town of
Pickering that are not owned or occupied by the Town;
(b) "Town" means The Corporation of the Town of Pickering";
(c) "Town property" includes:
(i)
buildings and structures within the Town of Picketing of which the Town is the owner,
lessee or licensee; and
(ii)
lands and premises within the Town of Picketing of which the Town is the registered
owner, lessee or licensee; and
(iii)
lands and/or premises within the Town of Picketing, the ownership of which has been
vested in the Town through statute or otherwise; and
without limiting the generality of the foregoing, includes those roads and road allowances under
the jurisdiction of the Town, whether open or closed.
No person shall throw, place or deposit refuse or debris on private property without authority from the
owner or occupant of such property.
No person shall throw, place or deposit refuse or debris on Town property without authority from the
Council of the Town or the General Manager of the Town.
Every person who contravenes any provision of this by-law is guilty of an offence and upon conviction
thereof is liable to a fine of not more than $5,000.00, exclusive of costs, which shall be recoverable under
the provisions of The Provincial Offences Act and all the provisions of the said Act shall apply to any
prosecution for any offence under the provisions of this by-law.
By-law 4171/93 is hereby repealed.
