BY-LAW NO. 524'6/9 8
Being a By-law to amend Restricted Area (Zoning) By-law 3036
as amended, for Lot 17, Plan 819 in the Town of Pickering, to
implement the Official Plan the Town of Picketing District
Planning Area, Region of Durham. (A 31/97)
WHEREAS the Council of the Corporation of the Town of Pickering deems it desirable to permit
a second dwelling unit within a proposed detached dwelling unit on Lot 17, Plan 819, in the
Town of Pickering;
AND WHEREAS an amendment to By-law 3036, as amended, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
TEXT AMENDMENT
(1) SECTION 9 - ONE-FAMILY DETACHED DWELLING; THIRD DENSITY
ZONE - R3 is hereby amended by adding the following after subsection 9.3.3.6:
9.3.3.7 LOT 17, PLAN 819
(1) Notwithstanding any other provisions of this By-law, a detached
dwelling unit on Lot 17, Plan 819 may include a second dwelling
trait;
(2) Notwithstanding section 9.2.3 Yard Requirements, a detached
dwelling on Lot 17, Plan 819 shall be subject to the following
requirements:
(i) FRONT YARD (minimum): 4.5 metres
(ii) REAR YARD (minimum): 40.0 metres
(iii)SIDE YARD (minimum): 2.4 metres
(3) A detached dwelling on Lot 17, Plan 819 must also comply with
the following provisions:
(i)
(ii)
BUILDING HEIGHT (maximum):
9.0 metres
PARKING REQUIREMENTS:
(a) a minimum of one parking space shall be provided for a
second dwelling unit; and
(b)
where the vehicular entrance to a private garage is
parallel to the front lot line, no part of a private garage
shall be less than 6.0 metres from the front lot line, and
no part of an attached private garage shall extend more
than 2.4 metres beyond the wall containing the main
entrance to the dwelling unit to which it is attached; or

(c)
where the vehicular entrance to an attached private
garage is perpendicular to the front lot line, no part of
the garage shall be located less than 4.5 metres from the
front lot line.
ZONING BY-LAW 3036
By-law 3036, as amended, is hereby further amended only to the extent necessary to give
effect to the provisions of these By-law. Definitions and subject matters not specifically
dealt with in this By-law shall be governed by relevant provisions of By-law 3036, as
amended.
EFFECTIVE DATE
This By-law shall take effect from the day of passing, subject to the approval of the
Ontario Municipal Board, if required.
