HomeMy WebLinkAboutBy-law 5244/98THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 5244/98 Being a By-law to amend Restricted Area (Zoning) By-law 2520, as amended by By-law 1579/82, to implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham, in Part of Block B, Plan M-11, in the Town of Picketing. (A 24/97) WHEREAS the Council of the Corporation of the Town of Picketing passed By-law 1579/82, amending By-law 2520, to permit a commercial building and uses on the subject lands, being Part of Block B, Plan M-11, in the Town of Picketing; AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it desirable to further amend By-law 2520, as amended by By-law 1579/82, to permit the addition of retail store and restaurant uses to the list of permitted uses on the subject lands; AND WHEREAS an amendment to amending By-law 1579/82 to By-law 2520, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: By-law 1579/82, amending By-law 2520, as amended, passed by the Council of the Corporation of the Town of Picketing on the 18th day of October, 1982, is hereby further amended only to the extent necessary to give effect to the provisions of Section 2. hereof. TEXT AMENDMENTS (1) Section 4. of the said By-law is hereby amended by renumbering Subsection (10) as Subsection (12) and by adding thereto the following Subsections: (10) "Restaurant Type G" shall mean a building or part of a building where food is prepared and offered or kept for retail sale to the public for immediate consumption on the premises or off the premises, and which may include an accessory take-out component, but shall not include a drive-through. (11) "Retail Store" shall mean a building or part of a building in which goods, wares, merchandise, substances, articles, or things are stored, offered, or kept for sale at retail, and includes storage on or about the store premises of limited quantities of such goods, wares, merchandise, substances, articles, or things sufficient only to service such store, but does not include any retail outlet otherwise classified or defined in the By-law. (2) Subsection 5.(1) of the said By-law is hereby amended by adding thereto the following Clauses: (g) restaurant Type G (h) retail store (3) -2- Clause 5.(2)0) of the said By-law is hereby amended by adding thereto the following Subclauses: (iii) a maximum of 1 restaurant Type G shall be permitted on the subject lands, with a maximum gross floor area of 200 square metres. (iv) the gross floor area of any retail store shall not exceed 400 square metres. o EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
