THE CORPORATION OF THE TOWN OF PICKERING
BY-LAW NUMBER 5235/98
Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended by
By-laws 1680/83, 1727/83, and 2006/85, to implement the Official Plan of the
Town of Picketing District Planning Area, Region of Durham in Part of Lot 23,
Concession 1, in the Town of Picketing. (A 4/96)
WHEREAS the Council of the Corporation of the Town of Picketing passed By-laws 1680/83
and 1727/83, amending By-law 3036, to permit the development of retail and personal service
commercial uses and a greenbelt area on the subject lands, being Part of Lot 23, Concession 1,
Town of Picketing;
AND WHEREAS the Council of the Corporation of the Town of Picketing passed By-law
2006/85, amending By-law 1680/83, to remove certain temporary access points;
AND WHEREAS the Council of the Corporation of the Town of Picketing now deems it
desirable to further amend By-law 3036, as amended by By-laws 1680/83 and 1727/83 and
2006/85, to permit outdoor storage to permit the establishment of a garden centre and reduced
parking requirements from April 1 to June 30 of each calendar year on the subject lands, being
Part Lot 23, Concession 1, Town of Picketing;
AND WHEREAS an amendment to By-law 3036, as amended by By-laws 1680/83 and 1727/83
and 2006/85, is therefore deemed necessary;
NOW THEREFORE THE ONTARIO MUNICIPAL BOARD AMENDS BY-LAW 3036,
AS AMENDED, AS FOLLOWS:
1. TEXT AMENDMENT
(1)
Section 5.(1)(b)(vii), SPECIAL RESTRICTIONS, of By-law 1680/83, as
amended by By-laws 1727/83 and 2006/85, is hereby further amended by adding
thereto
G (I)
Despite any provisions of By-law 3036, as amended by By-laws
1680/83, 1727/83 and 2006/85, a portion of the parking area as
generally identified by the crosshatched area within Area 5 on
Schedule A to amending By-law 1727/83, as amended by By-law
2006/85, may be used for 430 square metres of outdoor storage
associated with a garden centre use from April 1 to June 30 of
every calendar year.
(II)
Despite the parking requirements of Section 5(1)(b)(vi) of
amending By-law 1680/83 to By-law 3036, as further amended by
By-laws 1727/83 and 2006/85, a minimum of 566 parking spaces
are required to be provided from April 1 to June 30 of every
calendar year, while the omdoor storage associated with a garden
centre use exists within the parking area as generally identified by
the crosshatched area within Area 5 on Schedule A to amending
By-law 1727/83, as amended by By-law 2006/85.

2. SCHEDULE AMENDMENT
Schedule II to By-law 1680/83, as replaced by Schedule A of By-law 1727/83, and
amended by By-law 2006/85, is hereby further amended by adding thereto a crosshatched
area within the north-western quadrant of Area 5 in the general location identified on
Schedule I attached hereto.
3. REPEAL OF BY-LAW 4998/97
By-law 4998/97 is hereby repealed.
4. EFFECTIVE DATE
This By-law shall take effect from the date of the Order of the Ontario Municipal Board
amending Restricted Area (Zoning) By-law 3036 in accordance with this By-law.
