BY-LAW NO.. 52'15(/9 !3
Being a by-law to stop-up and close as public highway
those parts of the Road Allowance between Lots 30 and 31,
Range 3, B.F.C., Pickering, designated as Parts 3, 4 and 5,
Plan 40R-XXXXX,, and to authorize their sale to abutting
owners where not required for other rnunicipal purposes.
WHEREAS, pursuant to section 297(1)(a) of the Municipal Act, R.S.O. 1990, chapter M.45, the Council of
The Corporation of the Town of Pickering enacted a By-law, dedicating, as public highway those parts of
the Road Allowance between Lots 30 and 31, Range 3, B.F.C., Pickering, designated as Parts 3, 4 and 5,
Plan 40R-XXXXX to become part of Rosebank Road; and;
WHEREAS, pursuant to sections 191(1), 297(1)(c), 297(1)(d) and 315 of that Act, the Council of the Town
may pass by-laws to stop-up a highway or part thereof and to authorize its sale or the sale of a part thereof at
a fixed price;
NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
The following portions of highway are hereby stopped up and closed to both vehicular and
pedestrian traffic:
Those parts of the Road Allowance between Lots 30 and 31, Range 3, B.F.C, Pickering,
designated as Parts 3, 4 and 5, Plan 40R-XXXXX.
The Corporation of the Town of Pickering shall dispose of utility easements over any of the lands
described in section 1, above, that presently contain utility structures of any nature or sort, to the
appropriate utility authority, including but not necessarily limited to, The Regional Municipality of
Durham, Bell Canada, Consumers Gas, and Pickering Hydro, at a sale price of $2.00 each.
(a)
That part of the Road Allowance between Lots 30 and 31, Range 3, B.F.C., Pickering,
designated as Parts 4 and 5, Plan 40R-XXXXX, shall be offered for sale to Yorkville Sound
at a sale price calculated on the basis of $95,000.00 per acre, subject to any utility easement
or easements previously granted or granted pursuant to section 2, above.
(b)
That part of the Road Allowance between Lots 30 and 31, Range 3, B.F.C., Pickering,
designated as Part 3, Plan 40R-XXXXX, shall be offered for sale to Mr. Massara at a sale
price calculated on the basis of $95,000.00 per acre, subject to any utility easement or
easements previously granted or granted pursuant to section 2, above.
In the event that the owner of land abutting Part 3, Plan 40R-XXXXX (Massara), declines to accept
the offer to sell, within 30 days following the date of such offer then the lands designated as Part 3,
Plan 40R-XXXXX shall be offered for sale to Yorkville Sound on the same terms and conditions as
previously offered to the abutting owner.

The Mayor and Clerk are hereby authorized to execute any documents approved by the Town
Solicitor and required to effect the dispositions, offers and transfers provided for in this By-law.
