I , ~ SPECIAL COUNCIL MEETING A Special Meeting of the Pickering Town Council was held on Mo~1ay, January 2Ç, 1996 at 7:30 p.m. PRESENT: Mayor Wayne Arthurs COUNCILLORS: M. Brenner R. Johnson E. Taylor - TOv.l1 Manager - Executive Director of Operations - Town Clerk This Special Meeting of Council was called by Mayor Arthurs pursuant to Section 3 of By-law 3665/91 (procedural By-law) to consider nominations br appointment to the vacant seat of Regional Councillor Ward 2 and other matters associated thereto. ill I. DELEGATIONS Norm Ronoluss, 1757 Silvml1om Square, stated th..it he supports Ralph Sutton for appointment to the vacant seat ùf Regional C')uncillor Ward 2 because he has found Mr. Sutton to fair but firm and is involved if. the community and is retired anJ can provide the t:me dIat is needed for the job. 2. Sue Miller, 1123 Timber Court, stated that she supports the appointment of Ralph Sutton btcause he is currattly a hydro commissioner and is res~'1ed by the staff and management. She It)ted that Mr. Sutton is dedicated, committd and ~rsonable and has committed much time to the Ajax/Pickering Hospital Foundation. 3. Henry Tesligte, 1127 Timber Court, stated that he represents the Marshall Farms Community AJsociation and supports the appointment of Ralph Sutton. He noted that Mr. Sutton is very involved in the community and because he is retired, he has the time for the position and the enthusiasm. . . 10. . . II. - , 10 m DELEGATIONS 4. Don Mitchell, 1124 Timber Court, stated that he supports the appøint of Ralph Sutton because as the President of a ratepayers association in Scarb.')rough, Mr. Sutton was successful and involved. He noted that Mr. Sutton is involved in many charities and has many good qualities for public office. Mr. Mitchell asked that any person who is not a resident of the Ward not be appointed. 5. Ralph Sutton, 1104 Timber Court, stated that he would like to serve the community in either the Regional or Local Councillor seat. He noted tlwl he is committed to the community through his involvement O~l the Pickering Hydro- Electric Commission, various charities and community grOl.ops. 6. David Matthews, 714 Annland Street, stated that he wants or'y a resident of Ward 2 to represent the Ward and felt that Council should not appvmt someone who lost in the last regular election. 7. Alan May, 895 Sandy Beach Road, Unit 12, stated that he owns a business in Ward 2 and noted that the Regional Council seat should be filled by the present Local Councillor and that her vacant seat be filled by appointment or by-election. 8. Janice Frampton, representing the Taxpayers Coalition of Pickering and Ajax, stated that the Local Councillor should be promoted to the vacant Regional Councillor seat. 9. David Strain, 1201 Halsey Lane, asked that Council listen to the residents of Ward 2. He recommended that Council hire a polIing company to determine the support for the various candidates and make its decision based on the results of that poll. Bruce Palanik, 1800 Bronte Square, stated that the residents of Ward 2 need a ' strong voice at the Region to deal with the GT A. He stated that Councillor Senis should be appointed to the vacant seat and that her position be filled by a by- election. She has been elected and has worked with David Farr and the residents. Scott Smith, 1875 Malden Crescent, stated that David Farr expressed his desire to have Councillor Senis promoted to his seat when it was vacant. He noted that Councillor Senis was elected in the last regular election to represent the residents of Ward 2. He read a letter ftom Louise Farr who expressed her husband's wish that Councillor Senis be appointed to his seat when it became vacant. 12. Gerry Lawrie, 925 Bayly Street, stated that he had a petition ftom the OAC students at St. Mary Secondary School supporting the appointment of Councillor Senis. 13. Bill Hicks, 555 Steeple Hill, stated that he is the President of the South Pickering Senior Citizens. Since his Club is located in Ward 2, he is concerned about the appointment and supported the appointment of Councillor SeI1is. 14. Marilyn Hedge, 557 Marksbury Road, stated that she supports the appointment of Councillor Senis because she has worked with her on the Frenchman's Bay Festival and other community events. 15. Louise Boehlar, 889 Antonio Street, stated that she represents various groups and charities in the Town. She stated that she supports the appointment of Councillor Senis and that a by-election be held to fill her position. 16. TIll Foster, 1049 Dalewood Drive, stated that she is capable and qualified to sit on Council. She wants to preserve the assets of the Town and respond to future challenges. She is committed to the Town and is presently the Chair of the Public Library Board. She noted that she has been involved in other community groups and her career WU with the television media. . . . . - , II m DELEGATIONS 17. Richard Ward, Box 5142, Claremont, stated that he has been an observer of the political process and supports the concept of an appointltkmt instead of a by-Jaw to fill the vacant position. He felt the appointee does not need to live in Ward 2 and stated that he supports the appointment of Doug Dickerson. 18. David Cartwright, 1926 Malden Crescent, stated that Councillor Senis should b~ appointed to the vacant position because she has worked with David Farr and was elected by the residents of Ward 2 to represent them. 19. Chris Wood, 1529 Somergrove Crescent, stated that he has a petition signed by 86 OAC students at Pine Ridge Secondary School to support the appointment of Councillor Senis to the vacant position and hold a by-election to fill her position. 20. Charles Smith, 679 Annland Street, stated that he sees many changes occurring in the near future and supported Doug Dickerson for appointment to the vacant position. 21. Eileen Higdon, 852 Fairview Avenue, stated that she is available for appointment to the vacancy. She referred to her achievement on Council in the past term and wants to continue to OPPf,se the Brock West Landfill Site, keep taxes in line and facilitate the beautification of older areas. Cheryl Dickerson, 1298 Dona Park Road, stated that she supports the appointment of her father, Doug Dickerron, to the vacancy. He supporb the appointment of Doug Dickerson to the vacancy. 25. Brenda Birinyi. 778 Millbank Road. st8ted that she spoke to David Farr shC'rny before his death and it was his wish that Councillor Senis be appointed to fill hi! seat when it became vacant. She noted that Councillor Senis has taken over the duties of David Farro 26. Wayne Buksa, 1627 Belinda Court, stated that he supports the appoÍi,tment of Doug Dickerson to the vacancy because he is a successful businessman, a knowledgeable Councillor and a good mend. 27. Bill Brophy, 846 Naroch Boulevard, stated that he supports the appointment of Doug Dickerson to the vacancy became he has experience on the R~onal Council and he respects Doug Dickerson. 28. Myrna Picotte stated that she supports the appointment vf Doug Dickerson to the vacancy because he is a oons.,;entiolJs person whom she wouldn't hesitate to tùre for her own business. 29. Bill Boyes, 1159 Canborough Crescent, stated that Council should look at all facets of each of the candidates. He supports the appointment of fill Foster to the vacancy because she has experience, she is committe"- and is involved :n the community. 31. Pat Ma.-uon, 838 Miriam Road, stated that he supports the appointment of Doug Dickerson to the vacancy becàuse he has experience and lives in Ward 2. 32. Tom Mohr, 842 Naroch Boulevard, stated that the person appointed to fill the vø.cancy must COJnÞ ftom Ward 2 and the appointment must not be politically expedient. He supports the appointment of Doug Dickerson because of his experience. Helen Dion, 506 Petticoat Lane, stated that she supports the appointment of Doug Dickerson because he is experienceQ and lives ir. Ward 2. Bernie Luttmer, 633A Liverpool Road, stated that he supports the appointment of Councillor Senis because ~ìe has been elected by the residents of Ward 2 and there should be a by..efectioit to -ru her position. Maria Javor, 870 Strouds Lane, stated that she supports the appointment of Doug Dickerson based on his past work. Rodney Dale stated that he support s the appointment of Doug Dickerscn because he would be an asset on Council. Walter Kitchener, 723 Lublin Avenue, stated that he supports the appointment of Doug Dickerson because he has experience and maturity. Mario Dionne, 1186 Cedarcroft Crescent, supports the appointment of Doug Dickerson because he is honest and dedicated. Barbara Cillo, 719 Simpson Avenue, stated that she supports the appointment of Doug Dickerson because he is honest. Ruth Ann Scltedlich., 981 Essa Crescent, stated that she supports the appointment of Councillor Senis because she has worked hard and was involved in the community with David Farr. 52. Helen Wisbnowski, 727 Lublin Avenue, stated that she supports the appointment of Doug Dickerson. 53. Sandy McKechnie. 737 Breezy Drive, stated that she would move back to Ward 2 if she were appointed to the vacant position. She noted that her past work gives her a knowledge and perspective of the Town. 54. Gerald Cole. 1503 Rawlings Drive, stated that he supports the appointment of Doug Dickerson. Doug Dickerson stated that he has been on Council and wants to serve the community again. He noted that he has experience and knows the political processes and that he can deal with the many changes and cha11ehges to be met in the near future. . 55. . . . . - - 14 m DELEGATIONS 56. Jacqueline Smart, 829 Fairview Avenue, stated that she supports the appointment of Councillor Senis because she was elected by the residents of Ward 2 and she was supported by David Farr. Kip Van Kempen stated that Council should determine how appointments were made in the past and request what is wanted by the community. He noted that Ajax appointed a membÅ’ of Council to a ~acant Regional Council seat recently. 58. 59. Mrs. Whitely, Maple Ridge Drive, stated that she supports the appointment of Councillor Senis. Recorded Vote: CARRIED Yes: Councillors Brenner, Johnson, Pistritto, Ryan and Mayor Arthurs No: Councillor Senis Councillor Dìclcerson gave Iús Declaration of Elected Office and Oath of Allegiance and assumed the seat of Regional Councillor Ward 2. am NOTICF OF MOTION The following Notice of Motion was introduced by Councillor Ryan, Seconded by Councillor Pistritto: WHEREAS Section 9(9) of the Regional Municipalities Act states that a vacancy in the office of a member of a Regional Council, other than the head of the council of an area municipality, can only be filled by appointment within sixty days after the vacancy occurs; and WHEREAS both the Regional Municipalities Act and the Municipal Act provide ror a council to chose if it wishes to hold a by-election or make an appointment to fill the V8CIIIC)' in the office of Mayor or Local CounciUor, and WHEREAS the requirement to fill the vacancy in the office of a Regional Councillor by appointment only is an impediment to iliê democratic process of ùJowing the residents to seIccC the penon they wish to have represent them; and - . . . ~ , . 16 mn NOTICE OF MOTION - condnued WHEREAS an appointment precludes any f)Ubliç input and debate of the current ÌI8ueI and candidates for office; and WHEREAS an appointment puts an unfair onus on the members of a council who do not represent the area to which the vacancy applies to decide who will ñll tlat vacancy; and WHEREAS there should be consistency in the applicable statutes that provides for a council to decide if it wishes to bold a by-election or mùe an appointment to a vacancy for any office on a council; .
