(II) Adoption of Minutes Moved by Tom Copeland Seconded by Sean Wiley Carried Unanimously That the minutes of the 4th meeting of the Committee of Adjustment held Wednesday, March 29, 2017 be adopted. Ellis 1448 Rosebank Road Committee of Adjustment Meeting Minutes Wednesday, April 19, 2017 7:00pm Main Committee Room The applicant requests relief from Zoning By-law 3036, as amended, to permit a minimum side yard width of 1.2 metres; whereas the by-law requires a minimum side yard width of 1.5 metres, where a garage is erected as part of a detached dwelling. The applicant requests approval of this minor variance application in order to obtain a building permit to construct a two-storey detached dwelling. The Manager, Development Review & Urban Design outlined the staff recommendation from the City Development Department recommending approval subject to conditions. Written comments were also received from the City's Engineering Services Department expressing no comments on the application. Bradley Ellis, applicant, was present to represent the application. Richard Hansen of 1450 Rosebank Road was present in objection to the application. Bradley Ellis explained the application and stated that the proposed dwelling will improve the surrounding neighborhood. Richard Hansen expressed concerns with the proposed two-storey detached dwelling casting shadows on his property and the 1.2 metre side yard width may decrease the walkway between dwellings. In response to a question from a Committee Member, Bradley Ellis stated that there are no windows proposed on the north elevation at this time. He also explained that the dashed lines on the submitted plan represent the existing structures. In response to a question from a Committee Member, the Manager, Development Review & Urban Design stated that there are other properties within this neighbourhood where minor variances have been approved to have a minimum side yard width of 1.2 metres. Ellis, be Approved on the grounds that the minimum side yard width of 1.2 metres, where a garage is erected as part of a detached dwelling, is minor in nature, desirable for the appropriate development of the land, and in keeping . with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following condition: 1. That the applicant obtain a building permit for the proposed construction by April 19, 2019, or this decision shall become null and void. 2. PICA 26117 M. Labalestra & S. Mason 1246 Ilona Park Road Carried Unanimously The applicant requests relief from Zoning By-law 2520, as amended, to permit a minimum north side yard width of 0.6 of a metre; whereas the by-law requires a minimum side yard width of 1.5 metres, where a garage is erected as part of a detached dwelling. The applicant requests approval of this variance in order to obtain a building permit to convert an existing carport into an enclosed attached garage. The Manager, Development Review & Urban Design outlined the staff recommendation from the City Development Department recommending approval subject to conditions. Written comments were also received from the City's Engineering Services Department expressing no comments on the application. Matthew Labalestra, applicant, was present to represent the application. No further representation was present in favour of or in objection to the application. In response to questions from Committee Members, Matthew Labalestra stated that the existing shed will remain and will only be constructing new walls to enclose the existing carport. Labalestra & S. Mason, be Approved on the grounds that the north side yard width of 0.6 of a metre is minor in nature, desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That this variance apply only to the proposed enclosed attached garage, as generally sited and outlined on the applicant's submitted plans. 2. That the applicant obtain a building permit for the proposed construction by April 19, 2019, or this decision shall become null and void. 3. PICA 27117 SR&R Bay Ridges (Plaza II) Ltd. 1255 Bayly Street Carried Unanimously The applicant requests relief from Zoning By-law 3036, as amended by By-laws 6705106, 6786107, and 7006109: • to permit a maximum of 787 units; whereas for residential uses, the by-law requires the lands to be developed up to a maximum of 777 units, as approved by the Committee of Adjustment on September 14, 2016 • to permit a maximum building height of 26 storeys and 78 metres for multiple dwelling vertical uses; whereas the by-law requires a maximum building height of 25 storeys and 78 metres for multiple dwelling vertical uses The applicant requests approval of these variances in order to obtain Site Plan Approval for a 26 storey apartment building containing 241 units. The Manager, Development Review & Urban Design outlined the staff recommendation from the City Development Department recommending approval subject to conditions. Written comments were received from the City's Engineering Services Department expressing no comments on the application. Written comments were also received from Regional Councillor, Ward 1, Kevin Ashe, Regional Councillor, Ward 2, Bill Mclean, and Regional Councillor, Ward 3 David Pickles, expressing support of staff recommendations. No further representation was present in favour of or in objection to the application. In response to questions from Committee Members, Ryan Guetter stated that the overall height of the building is less than the maximum building height requirement in the zoning by-law and each floor has a height of 2.95 metres. Ryan Guetter also stated that the approval of these variances will result in a parking supply of 1 space per unit, plus 0.15 space per unit for visitors and 1.5 visitor spaces per resident/suite. In response to a question from a Committee Member, the Manager, Development Review & Urban Design outlined that this application slightly exceeds the density requirements outlined in the Official Plan. It does appear to be desirable for the appropriate development of the land and the requested variances are in keeping with the general intent and purpose of the Official Plan and Zoning By-law. Moved by Tom Copeland Seconded by Eric Newton That application PICA 27/17 by SR&R Bay Ridges (Plaza II) Ltd., be Approved on the grounds that the requested variances are minor in nature, desirable for the appropriate development of the land, and in keeping with the general intent and purpose of the Official Plan and the Zoning By-law, subject to the following conditions: 1. That the variance for maximum building height apply only to Building 'C', as generally sited and outlined on the applicant's submitted plans. 2. That the applicant obtain Site Plan Approval for the proposed development or this decision shall become null and void.
